«Փաստ» օրաթերթը գրում է
Արդարադատության նախարարությունն առաջարկում է լրացումներ կատարել «Վարչական իրավախախտումների վերաբերյալ» օրենսգրքում, մասնավորապես՝ նախագծով նախատեսվող իրավակարգավորումների արդյունքում հնարավոր կլինի հանրային աշխատանքը նախատեսել որպես վարչական տույժի տեսակ: Նշվում է, որ ՀՀ վարչական իրավախախտումների վերաբերյալ օրենսգիրքը հանրային աշխատանքները չի նախատեսել որպես վարչական տույժի տեսակ, մինչդեռ այլ երկրներում դրանք ամենատարածվածներից են։
Հանրային աշխատանքները ՀՀ-ում նախատեսված են միայն Քրեական օրենսգրքով, որի 54-րդ հոդվածի 2-րդ մասի համաձայն՝ դրանք կարող են նշանակվել ոչ մեծ կամ միջին ծանրության հանցագործություններ կատարած, առավելագույնը երկու տարի ժամկետով ազատազրկման դատապարտված անձանց նկատմամբ։ Հանրային աշխատանքներն ունեն մի քանի նպատակ՝ հասնել անձի ուղղմանը՝ նրա նկատմամբ վերահսկողություն իրականացնելու, ոչ թե պատժելու միջոցով, հասնել կրկնահանցագործությունների թվի նվազմանը՝ առանց անձին իր ընտանիքից և շրջապատից մեկուսացնելու և հետագայում հասարակություն վերաինտեգրվելու խնդիր առաջացնելու, վերականգնել հասարակությանը պատճառված վնասը, լուծել բանտերի բեռնվածության խնդիրը, խնայել պետության ֆինանսական և մարդկային ռեսուրսները։
Հանրային քննարկման ներկայացված այս նախագծով առաջարկվում է հանրային աշխատանքները նախատեսել որպես այլընտրանքային տույժի տեսակ, եթե նշանակված տուգանքի չափը հավասար է կամ գերազանցում է նվազագույն աշխատավարձի 30-ապատիկը և վարչական պատասխանատվության ենթարկված անձը, իր նյու թ ա կան վի ճակի պատճառով զրկված լինելով տուգանքը վճարելու հնարավորությունից, մինչև տուգանքը նշանակելու մասին որոշումն անբողոքարկելի դառնալը այդ մասին գրավոր դիմում է ներկայացնում վարչական իրավախախտման վերաբերյալ վարույթ իրականացնող մարմնին:
Նախագծով սահմանվել է նաև հանրային աշխատանքների առավելագույն ժամաքանակը, սահմանվել տուգանքը հանրային աշխատանքով փոխարինելու մեխանիզմը: Կարգավորվել են նաև հանրային աշխատանքներ նշանակելու մասին որոշման կատարման և դրանք կատարելուց խուսափելու հետ կապված հարցերը:
