ՍԴ որոշումը չի պարտավորեցնում գործատուին վճարելու աշխատողի ՊՇՌ թեստի գումարը
SOCIETYՍահմանադրական դատարանի որոշմամբ ո´չ պետությունը, ո´չ գործատուն, ո´չ որևիցե այլ անձ ուղղակիորեն չեն պարտավորեցվել վճարելու աշխատողի ՊՇՌ հետազոտության թեստի գումարը: Այս մասին ԼՈՒՐԵՐ․com-ի հետ զրույցում ասաց ՀՀ առողջապահության նախարարության իրավաբանական վարչության պետ Աննա Մկրտումյանը։
Նա նշեց, որ աշխատող բոլոր անձինք պետք է նույն ընթացակարգով անցնեն ՊՇՌ հետազոտություն, պարզապես ՍԴ-ն հակասահմանադրական է ճանաչել առողջապահության նախարարի հրամանի բոլոր հավելվածների միայն «իրականացնում է աշխատողն՝ իր հաշվին» ձևակերպումը․ «Այսինքն՝ «իր հաշվին» ձևակերպումը կանխորոշել է բացառապես հստակ շրջանակ աշխատողների համար, այժմ ՍԴ-ն ասում է, որ մի դրեք այդ սահմանափակումն անձի վրա, որ ինքը իր հաշվին իրականացնի, կարող է իրականացնել ցանկացած այլ անձի հաշվին, ով կամային մոտեցմամբ կտա իր համաձայնությունը վճարելու աշխատողի ՊՇՌ հետազոտության գումարը, դա սեփական ցանկությամբ է և կարող է լինել նույնիսկ գործատուն, եթե նա նման ցանկություն հայտնի: Սա է եղել ՍԴ-ի որոշման եզրափակիչ մասի համապատասխան դրույթի բովանդակությունը»,- ասաց Մկրտումյանը։
