Իշխանության ներկայացուցիչները հայտարարել են, որ պետք է պարզել, թե ինչ հանգամանքներում են գերեվարվել զինծառայողները։

Այս թեմայի շուրջ զրուցել ենք ՄԻԵԴ-ում գերիների հարցով իրավապաշտպան Սիրանուշ Սահակյանի հետ։

Հարցին, թե իրավապաշտպանն ի՞նչ կարծիք ունի այս գործերի վերաբերյալ` Սիրանուշ Սահակյանն ասաց․ «Նախ կալանքի հարցը պետք է տարանջատել հիմնական արարքից ու մեղավորությունից։ Արարքների մասով մենք կարծում ենք, որ եղած փաստերի պարագայում իրավական գնահատականը սխալ է տրված։ Եվ արարքներում ուղղակի հանցագործություններ չկան։ Նաև նշեմ, որ կամովին գերի ընկնելու առնչությամբ չեն հարուցվել այդ քրեական գործերը, հիմնականում մարտական ծառայության կանոնները խախտելն են վերագրում նրանց։ Այստեղ մի կողմից խնդիր կա, որ չի կոնկրետացվում, թե որ կանոնը խախտվեց, որը առաջ բերեց հնարավոր հետևանքները։ Եվ երկրորդը, այդ մարտական կանոնների պարագայում պետությունը ևս կրում է պոզիտիվ պարտականություններ, օրինակ, դիրքի կահավորանքից սկսած մինչև պատշաճ զինվածության աստիճանի բերելը։ Եվ այստեղ կա նաև խնդիր, որ ծառությունը չի կազմակերպվել օրենքի տառին համապատասխան, և պետությունը զինծառայողների հանդեպ իր կենսական պարտավորությունները չի կատարել։

Իսկ կալանավորումների առումով պետք է ասեմ, որ նախ փախուստի կամ արդարադատությանը միջամտելու վտանգներն իսկապես բացակայել են։ Դրան համակցվում է առողջական վիճակը։ Շատերի պարագայում եղել են լուրջ կոտրվածքներ, որոնք ուղեկցվել են վիրահատություններով։ Եվ ֆիզիկական ու հոգեբանական խնդիրներ ունեցող անձին անազատության մեջ պահելը նաև հոգեբանական տառապանք է առաջ բերում, որն ընդհուպ մինչև կարող է խախտել Հայաստանի պարտավորությունները Եվրոպական կոնվենցիայի ներքո։ Այստեղ անմարդակային վերաբերմունքի չարժանացնելը բացարձակ արգելք է, և առողջական խնդիրների գոյության պայմաններում այդ խստագույն միջոցը կիրառելն ուղղակի չի արտացոլում հումանիզմը և շատ դեպքերում պատժիչ գործոն է դառնում, որովհետև զինծառայողներն ստիպված են լինում ինքնախոստովանական ցուցմունքներ տալ։ Մեր վստահորդների պարագայում էլ եղել են դեպքեր, երբ նրանք ի սկզբանե անազատության մեջ գտնվելով՝ մեղք են ընդունել արարքների համար։ Եվ հետագայում, երբ մենք ներգրավվել ենք, բացատրել ենք նրանց իրավունքները և վեր ենք հանել խնդիրները, այստեղ մարդիկ նոր կարողացել են իրական կամարտահայտությամբ դիրքորոշում արտահայտել։ Եվ այս պահի դրությամբ չեն ընդունում իրենց մեղավորությունը։

Մի բացասական երևույթի մասին էլ ենք բարձրաձայնում, երբ կալանքներ են կիրառվել առաջին ատյանի դատարանի կողմից, մեր վստահորդների մասով մենք դրանք բողոքարկել ենք, բայց վերաքննությունն ուշացած է կազմակերպվում։ Մենք ունենք դեպք, երբ երկրորդ միջնորդությունն է ներկայացվել, առաջին ատյանի դատարանը մերժել է կալանքը, և անձը հայտնվել է կալանքի մեջ, բայց նրա նախորդ կալանքի օրինականությունը շատ ուշացած ձևով է վերանայվել վերաքննիչ դատարանի կողմից։ Դա նշանակում է, որ վերաքննիչ օղակն անձնական ազատության իրավունքի պաշտպանության առումով դառնում է ոչ այնքան արդյունավետ մեխանիզմ մեր երկրում»։
