«Փաստ» օրաթերթը գրում է
ՀՀ տարածքային կառավարման և ենթակառուցվածքների նախարարության՝ հանրային քննարկման ներկայացված նախագծի անհրաժեշտությունը հետևյալն է՝ խնդիր է առաջացել իրավական ակտերը համապատասխանեցնել ««Հուղարկավորությունների կազմակերպման և գերեզմանատների ու դիակիզարանների շահագործման մասին» օրենքում փոփոխություններ և լրացումներ կատարելու մասին» թիվ ՀՕ-228-Ն ՀՀ օրենքով և 2021 թ.-ի մայիսի 27-ին ընդունված «Վարչական իրավախախտումների վերաբերյալ ՀՀ օրենսգրքում լրացումներ և փոփոխություններ կատարելու մասին» թիվ ՀՕ-229-Ն ՀՀ օրենքով կատարված փոփոխություններին և լրացումներին:
Օրենքի 8-րդ հոդվածի 3-րդ մասով սահմանված է, որ այն ուժի մեջ մտնելուց հետո՝ եռամսյա ժամկետում անհրաժեշտ է լրացումներ և փոփոխություններ կատարել հիշյալ իրավական ակտերում (օրենքն ուժի մեջ է մտել 2022 թվականի հունվարի 1-ից)։ Օրենսդրությամբ կարգավորվում են հետևյալ փոփոխությունները՝ ներդրվել է «գերեզմանօգտագործող» և «ընտանիքի անդամներ» հասկացությունները և սահմանվել շրջանակը, սահմանվել է նոր գերեզմանատների և գերեզմանների կառուցապատման և բարեկարգման տիպային ձևերը հաստատելու պահանջը, հստակեցվել է հուղարկավորությունների իրականացման վայրերի շրջանակը (գերեզմանատեղի տրամադրումը), հանվել է գերեզմանատներում վճարովի հիմունքներով հողատարածքի տրամադրումը։
Գերեզմանատներում հողատարածքը տրամադրվում է միայն անվճար հիմունքներով, հստակեցվել է տրամադրվող հողատարածքի չափերը՝ մեկ գերեզմանի համար 2.5 քառակուսի մետր հողատարածք (2.5x1.0 մետր չափերով) և ընտանեկան գերեզմանի համար մինչև 12.5 քառակուսի մետր հողատարածք (2.5x5 մետր չափերով), խստացվել է գերեզմանատան կազմակերպման համար նախատեսված վայրերից դուրս հուղարկավորության իրականացումը։ Նախագծի հիմնավորման մեջ նշվում է՝ Հայաստանի Հանրապետության վարչապետի որոշման նախագծի ընդունման դեպքում պետական կամ տեղական ինքնակառավարման մարմինների բյուջեներում եկամուտների և ծախսերի էական ավելացման կամ նվազեցման անհրաժեշտություն չի առաջանում։
