Արցախի Հանրապետությունը չի հրաժարվում իր տարածքներից

Արցախի խորհրդարանի պատգամավորները մշակել են «Բռնազավթված տարածքների մասին» նախագիծ։ Ըստ այդմ՝ իրավական կարգավիճակ է տրվում Արցախի օկուպացված տարածքներին:
Այս թեմայի մասին զրուցել ենք Ազգային ժողովի նախկին պատգամավոր Տարոն Սիմոնյանի հետ։
Հարցին, թե ինչպե՞ս եք գնահատում այս նախաձեռնությունը` Տարոն Սիմոնյանն ասաց. «Ես հրադադարից անմիջապես հետո կոչ էի անում, որ օր առաջ ընդունվեր այդ օրենքը։ Սա ուշացած նախաձեռնություն է, շուտ պետք է ընդունվեր, որովհետև ցանկացած պետություն, ում տարածքը բռնազավթում են, բռնազավթված տարածքների իրավական ռեժիմի վերաբերյալ կարգավորում պետք է ունենա։ Արցախն այս երկու տարի է՝ չուներ նման կարագավորում և լավ է, որ արդեն կունենա։ Այսինքն՝ սա ուշացած, բայց անհրաժեշտ քայլ է»։
Հարցին, թե իրավական տեսանկյունից ի՞նչ հնարավորություններ կարող է տալ այս օրենքի ընդունումը` նախկին պատամավորն ասաց. «Առաջինը, այս օրենքն ընդունելով՝ նշանակում է, որ Արցախի Հանրապետությունը չի հրաժարվում իր տարածքներից։ Այսինքն՝ դեռևս իրավական մակարդակում պահպանում է իր կապն այդ տարածքների հետ՝ պնդելով, որ այդ տարածքները միջազգային իրավունքի խախտմամբ գրավված տարածքներ են։ Հետևաբար, դրանք ապօրինաբար գրավված, զավթված տարածքներ են, իսկ այնտեղ կատարվող ցանկացած իրադարձություն փաստացի դուրս է Արցախի վերահսկողությունից։ Եվ, հետևաբար, Արցախի կառավարությունը պատասխանատվություն չի կրում այնտեղ կատարվող, օրինակ, մարդու իրավունքների խախտումների համար։ Ավելին, այնտեղ կատարվող շինարարական աշխատանքները, տնտեսական գործունեությունը և այլ աշխատանքները, եթե համաձայնեցված չեն Արցախի իշխանությունների հետ, ապա դրանք ապօրինի են։ Մուտքը, ելքը, ցանկացած հարաբերություն, որը տեղի է ունենում բռնազավթված տարածքներում՝ առանց Արցախի Հանրապետության իրավազոր պետական մարմինների թույլտվության, ապօրինի է։ Հետագայում, երբ որոշ ժամանակ անց այդ տարածքները կվերադառնան Արցախի վերահսկողության տակ, արդեն Արցախը կկարողանա իր օրենսդրության շրջանակներում ամբողջ իշխանությունը տարածել այդ տարածքների նկատմամբ և ապօրինի համարել նախկինում կատարված ցանկացած հարաբերություն, տնտեսական գործունեություն և այլն»։
