ԱՀ ՊԲ N զորամասի համապատասխան հրամանատարական կազմի կողմից ծառայության նկատմամբ անփույթ վերաբերմունք դրսևորելու դեպքի առթիվ հարուցված քրեական գործի նախաքննության ընթացքում 2021թ. օգոստոսի 25-ին ՊԲ զորամասի Դ-20 հրետանային դիվիզիոնի շտաբի պետ-հրամանատարի տեղակալ, կոչումով մայոր, Գ.Գ.-ին առաջադրվել է մեղադրանք ՀՀ քրեական օրենսգրքի 375-րդ հոդվածի 4-րդ մասով նախատեսված հանցավոր արարքներ կատարելու համար:

ՀՀ գլխավոր դատախազությունից հայտնում են, որ նախաքննությամբ ձեռք բերված ապացույցներով հիմնավորվել է, որ Գ.Գ.-ն, պաշտոնի բերումով լինելով նույն դիվիզիոնի ժամկետային և կրտսեր սպայական կազմի ուղղակի պետը, 2020թ. սեպտեմբերի 27-ին հայտարարված ռազմական դրության ժամանակ անձնական շահագրգռվածությունից ելնելով` սեփական կյանքը փրկելու նպատակով, դրսևորել է իշխանության անգործություն:

2020թ. հոկտեմբերի 12-ին ժամը 18:00-ի սահմաններում Վարանդայի/Ֆիզուլի/ շրջանում գտնվող «Ջուվառլու» կոչվող տեղամասում մարտական գործողություններին մասնակցելու ընթացքում հակառակորդի զինված խմբի կողմից կրակային դիրքի ձախակողմյան հատվածում տեղակայված նույն դիվիզիոնի 1-ին մարտկոցի անձնակազմի ուղղությամբ գրոհ ձեռնարկելուց և տարբեր զինատեսակներից կրակոցներ արձակելուց անմիջապես հետո ենթակա անձնակազմին օգնության հասնելու, ինքնապաշտպանությունը, ինչպես նաև անհրաժեշտության դեպքում վերջիններիս տարհանումը կազմակերպելու, ստորաբաժանման անընդմեջ ղեկավարումը կազմակերպելու և ապահովելու, ենթականերին իրավիճակից բխող խնդիրներ առաջադրելու փոխարեն ԳԱԶ 33081 մակնիշի ավտոմեքենայով՝ առանց հետամուտ լինելու  անգամ տվյալ մեքենայի անձնակազմի նստեցումը կազմակերպելուն, փախուստի է դիմել կրակային դիրքից:

Այդ գործողություններն առաջացրել են նյութական ծանր հետևանքներ. առանց պատշաճ ղեկավարման մնացած 1-ին մարտկոցի անձնակազմը թեև փորձել է հնարավոր միջոցներով և եղանակներով պաշտպանվել, սակայն հրամանատարական ղեկավարման բացակայության պայմաններում դա չի հաջողվել: Եվ համակարգված մարտական գործողություններ վարելու և միասնական ղեկավարման բացակայության հետևանքով զոհվել է նույն դիվիզիոնի 1-ին մարտկոցի թվով 20 զինծառայող:

Զորամասի Դ-20 ՀԴն  շտաբի պետ, մայոր Գ.Գ.-ին վերաբերելի մասն անջատվել է ընդհանուր գործից առանձին վարույթում, այդ մասով հայտարարվել է նախաքննության ավարտ:

Քրեական գործի նախաքննության օրինականության նկատմամբ հսկողություն իրականացնող դատախազը հաստատել է մեղադրական եզրակացությունը և քրեական գործը Գ.Գ.-ի վերաբերյալ մեղադրական եզրակացությամբ ուղարկվել է Սյունիքի մարզի ընդհանուր իրավասության դատարան՝  ըստ էության քննության համար:

Քրեական գործի մնացած մասով նախաքննությունը շարունակվում է: ՀՀ զինվորական դատախազության պատշաճ դատավարական հսկողության և հատուկ հետևողականության պայմաններում ձեռնարկվում են բոլոր անհրաժեշտ միջոցները՝ 2020թ. պատերազմին առնչվող նշված դրվագով՝ նշված տեղամասում ծավալված մարտական գործողությունների ընթացքում զինծառայողների համար ողբերգական հետևանքների առաջացման բոլոր հանգամանքները պարզելու և դրա համար պատասխանատու բոլոր անձանց արարքներին քրեաիրավական գնահատականներ տալու համար:
