Գերեվարված 62 շիրակցիներից 30-ը դեռևս գերության մեջ են, հայրենադարձված 32-ը տուժող են ճանաչվել

Հադրութի շրջանի Հին Թաղեր և Խծաբերդ տարածքում գերեվարված 62 շիրակցիներից 30-ը դեռևս գերության մեջ են գտնվում, հայրենադարձված 32 զինծառայողները քրեական գործի շրջանակներում տուժող են ճանաչվել։

Արցախյան երրորդ պատերազմի ժամանակ գերեվարվածներից ոչ մեկին մեղադրանք չի առաջադրվել։ Մեղադրյալի կարգավիճակ ունեն միայն 2021թ նոյեմբերի 16-ին գերեվարված զինծառայողներից 6-ը։ Այս մասին «Փաստինֆո»-ի գրավոր հարցմանն ի պատասխան հայտնել են ՀՀ քննչական կոմիտեից։

Նշենք, որ ՀՀ քննչական կոմիտե ուղարկված հարցմամբ խնդրել էինք հայտնել, թե 2020թ սեպտեմբերի 27-ից մինչև 2021թ նոյեմբերի 16-ն ընկած ժամանակահատվածում հայ զինծառայողների գերեվարման դեպքերի առթիվ քանի քրեական գործ է հարուցվել, հարուցված քրեական գործերի շրջանակներում քանի ռազմագերու է մեղադրանք առաջադրվել և ինչ հատկանիշներով, ինչ խափանման միջոց է կիրառվել վերջիններիս նկատմամբ, արդյո՞ք Հադրութի շրջանի Հին Թաղեր և Խծաբերդի տարածքում 62 շիրակցիների գերեվարման փաստի առթիվ հարուցված քրեական գործի շրջանակներում մեղադրյալի կարգավիճակ ունեն հայրենադարձված գերիները, ինչպես նաև՝ քանի ռազմագերի կամ գերեվարված քաղաքացիական անձինք են տուժող ճանաչվել՝ քրեական գործերով։

ՔԿ ԶՔԳՎ ՀԿԳ-ից ստացված պատասխանի համաձայն՝ ՀՀ քննչական կոմիտեի զինվորական քննչական գլխավոր վարչության հատկապես կարևոր գործերի քննության վարչությունում շարունակվում է Ադրբեջանի Հանրապետության ռազմաքաղաքական ղեկավարության կողմից Արցախի Հանրապետության դեմ ագրեսիվ պատերազմ սանձազերծելու և վարելու, ռազմական գործողությունների ընթացքում նախապես հավաքագրված վարձկաններ օգտագործելու, պատերազմ վարելու արգելված մեթոդներ և միջոցներ կիրառելու, քաղաքացիական բնակիչներին զինծառայողներից չտարբերակելու և Արցախի Հանրապետության խաղաղ բնակավայրերի քաղաքացիական բնակչությանը համակարգված, կանխամտածված և նպատակաուղղված գրոհների թիրախ դարձնելու, մասնավորապես՝ խորը թիկունքում գտնվող քաղաքացիական բնակչությանը և քաղաքացիական օբյեկտները ոչ ընտրովի հարձակման թիրախներ դարձնելու և հրետակոծելու, միջազգային մարդասիրական իրավունքի նորմերի լուրջ խախտումներ համարվող արարքներ կատարելու փաստերի առթիվ հարուցված քրեական գործի նախաքննությունը, որի շրջանակներում քննության առարկա են դարձվել նաև ագրեսիայի ակտի ընթացքում հայ զինծառայողների և քաղաքացիական անձանց գերեվարման բոլոր դեպքերը, այդ թվում՝ ռազմագերիների նկատմամբ միջազգային մարդասիրական իրավունքի նորմերի լուրջ խախտումներ համարվող արարքներ կատարելու դեպքերը։

Նույն աղբյուրի փոխանցմամբ՝ 2020թ դեկտեմբերի 13-ին Արցախի Հանրապետության Խծաբերդ գյուղի տարածքում մարտական հերթապահությունում ընդգրված 62 զինծառայողների գերեվարման փաստի առթիվ նույնպես առկա է հարուցված քրեական վարույթ։ Նշված 62 զինծառայողներից 30-ը 2022թ փետրվարի 9-ի դրությամբ Ադրբեջանում պահվում են գերության մեջ, ՀՀ-ին հանձնված մյուս 32 զնծառայողները քրեական վարույթի շրջանակներում ճանաչված են որպես տուժող, վերջիններիս նկատմամբ քրեական հետապնդում չի հարուցվել, այսինքն՝ վերջիններս մեղադրյալի կարգավիճակ չունեն։
