Քաղաքական հարթության մեջ ավելի երկխոսող կեցվածք պետք է ցուցաբերի Հայաստանի կառավարությունը

ՄԱԿ-ի արդարադատության միջազգային դատարանի նախորդ տարեվերջին կայացրած որոշումից հետո Բաքուն շարունակում է պահել հայ գերիներին։

Այս թեմայի մասկն զրուցել ենք փաստաբան Սիրանուշ Սահակյանի հետ։

Հարցին, թե միջազգային ի՞նչ մեխանիզմներ կան, որով կարող են ստիպել թշնամուն վերադարձնել գերիներին փաստաբանն ասաց. «Նախ պետք է հստակեցնենք՝ միջազգային դատարանը չի պահանջել անհապաղ ազատ արձակել Ադրբեջանում պահվող անձանց։ Եվ այդ մասով միջպետական գանգատի շրջանակում եղել է ձախողում, որը նաև քաղաքական մանիպուլյացիաների տեղիք է տվել և որոշակի առումով ավելի է ամրապնդել Ադրբեջանի դիրքավորումը։ Ռազմական գործողությունների ժամանակ գերեվարված անձինք պետք է ազատ արձակվեն, նման պահանջ ներկայացվել է Հայաստանի կառավարության կողմից, որը մերժվել է դատարանի կողմից։ Դատարանի կողմից բավարարված պահանջներում որևէ ձևակերպում չկա գերիներին ազատ արձակելու մասին։ Եթե նման ձևակերպում լիներ, դրան հաջորդող այլ իրավական և դիվանագիտական գործընթացներ էին լինելու։ Եվ սա այն հատվածն էր, որը մտահոգություններ առաջ բերեց ընտանիքների շրջանում, քանի որ Ադրբեջանը նաև աշխարհին ի ցույց դրեց, որ կարճաժամկետ հեռանկարում Հայաստանի կառավարությունն իրավական ճանապարհով ունակ չի եղել այս խնդիրները լուծել։ Եվ դրա լուծման միակ նպատակը քաղաքականն է, ուստի, քաղաքական հարթության մեջ ավելի երկխոսող կեցվածք պետք է ցուցաբերի Հայաստանի կառավարությունը»։

Հարցին, թե իսկ ինչո՞ւ է միջազգային դատարանը մերժել հայկական կողմի այդ պահանջը` փաստաբանն ասաց. «Նախ հասկանալի էր, որ հայցը սահմանափակված էր խտրականության կանխարգելման կոնվենցիայի հիմքով։ Եվ չափազանց լայն իրավական հարցադրումները, որոնք կարող էին կապված լինել Ժնևյան կոնվեցիաների դրույթների հետ, ամբողջովին չէին տեղավորվում այս շրջանակի մեջ։ Եվ այն, որ Ադրբեջանում դեռևս գերիներ կան, ամենևին էլ ուղղակիորեն չի հիմնավորում խտրականության հետեւանքով նրանց պահելու հանգամանքը։ Եվ այս մասով դատարանն ուներ հիմնավորումներ՝ չբավարարելու պահանջը։ Չեմ կարող քննադատության արժանացնել դատարանի դիրքորոշումը, կարող ենք քննարկման առարկա դարձնել, թե այդ ռիսկերը գնահատելով՝ տակտիկապես ճի՞շտ էր այդ պահանջը դնելը, եթե կար բարձր հավանականություն, որ դատարանը խտրականության բոլոր ձևերի կանխման կոնտեքստում ռազմագերիների խնդրով հատուկ միջոց չի կիրառի։ Միգուցե այդ պահանջը չդնելն ավելի արդարացված կարող էր լինել հետագա քաղաքական գործընթացներում, քան դնելը։ Բոլոր դեպքերում, եթե իրավական առումով հարցը բարձրաձայնվել է և մերժվել է, դրա ժամանակավոր քաղաքական օգուտներն անխուսափելիորեն հավաքելու է ադրբեջանական կողմը։ Եվ, կարծում եմ, քաղաքական պրոցեսներով գերիների խնդիրը լուծելու մասով Ադրբեջանը հիմա ավելի դիրքավորված է, քան մինչև միջազգային արդարադատության դատարանում այդ խնդրի քննարկումը»։
