«Մարտի 1»-ին վերաբերող շատ այլ գործեր դուրս են մնացել գլխավոր դատախազության տեսադաշտից

ՀՀ գլխավոր դատախազ Արթուր Դավթյանը վճռաբեկ բողոք է ներկայացրել դատարան՝ պահանջելով բեկանել տարիներ առաջ «Մարտի 1»-ի գործով որպես մեղադրյալ ներգրավված վարչապետ Նիկոլ Փաշինյանի մեղադրական դատավճիռը և արդարացնել նրան։

Այս թեմայի մասին զրուցել ենք փաստաբան, «Մարտի 1»-ին առնչվող «Քոչարյանը և մյուսները» գործով տուժողների ներկայացուցիչ Սեդա Սաֆարյանի հետ։

Հարցին, թե ինչ կարծիք ունի գլխավոր դատախազի բողոքի մասին` փաստաբանն ասաց. « Կարող եմ ասել, որ այդ բողոքը շատ ավելի վաղ պետք է ներկայացվեր, որովհետև այդ հիմքերն առկա են եղել նաև ավելի վաղ և ոչ միայն Նիկոլ Փաշինյանի գործով: «Մարտի 1»-ին վերաբերող շատ այլ գործեր դուրս են մնացել գլխավոր դատախազության տեսադաշտից, որոշ մասը որակվել է՝ ելնելով այն կանխավարկածից, թե արագացված կարգով գործերի լսումը գործերի վերանայման արգելք է, ինչին ես, իհարկե, համակարծիք չեմ, որովհետև անձի կողմից արագացված կարգ ընդունելը 2008 թվականին բացարձակապես պայմանավորված չի եղել այն հանգամանքով, որ ինքն այդ մեղադրանքն ընդունում է: Դա ուղղակի հազար ու մի խնդիրներ ունենալու հանգամանքներով է պայմանավորված եղել, ինչը չպետք է կարևորվեր: «Մարտի 1»-ի գործը մի տեսակ մաս-մաս ու այսպես անհատական ու դանդաղ վերանայումների է արժանացել, ինչն ընդունելի չէ, որովհետև դա կարող էր միասնաբար քննվել ու թեթևացնել «Մարտի 1»-ի գործով դատական անարդար ակտերի վիճակը: Հետևապես՝ չեմ կարող ասել, թե ինչո՞վ է պայմանավորված գլխավոր դատախազության կողմից ժամանակի այս ընտրությունը: Լավ է, որ վերջապես այդ որոշումը կայացվել է, գիտեք՝ ամբաստանյալ Ռոբերտ Քոչարյանի պաշտպանների կողմից անվերջ շահարկվել է «Մարտի 1»-ի գործով այդ դատական ակտը: Չգիտեմ` ինչու, «Մարտի 1»-ի գործով այսպիսի ձախողումից հետո է այս հարցը բարձրացվել ու լսվել, ինձ համար շատ անհասկանալի է, որովհետև դատախազության աշխատողները մասնակցել են «Մարտի 1»-ի գործին ու տեսել, որ այդ դատական ակտերը, յոթի գործը՝ այդ բոլորը շահարկվում են: Ինչո՞ւ թողեցին, որ շահարկվի, ու «Մարտի 1»-ի գործի ձախողումից հետո նոր այսպիսի որոշումներ են ընդունում: Միայն իրենք կարող են բացատրել այս վերանայման դինամիկան»:
