Գումարտակի մի շարք զինծառայողներ զոհվել են, անհայտ կորել, գերեվարվել
SOCIETYԱրցախյան պատերազմին առնչվող քրեական գործի քննությամբ ձեռք բերված բավարար ապացույցներով հիմնավորվել է, որ ՊԲ N զորամասի նորակոչիկների գումարտակի հրամանատար, մայոր Ի.Վ.-ն, հանդիսանալով նույն ստորաբաժանման ժամկետային և կրտսեր սպայական կազմի ուղղակի պետը, 2020թ. սեպտեմբերի 27-ին ՀՀ կառավարության կողմից հայտարարված ռազմական դրության պայմաններում, 2020թ. հոկտեմբերի 10-ին՝ ժամը 12:00-ի սահմաններում, Արցախի Հանրապետության Հադրութ քաղաքի մոտակայքում գտնվող «Խուռհատ» սարի վրա տեղի ունեցած մարտական գործողություններին ակտիվ մասնակցություն չունենալու և սեփական կյանքը չվտանգելու անձնական շահագրգռվածությունից ելնելով՝ դրսևորել է իշխանության անգործություն: Մասնավորապես, նա չի կատարել իր վրա ՀՀ ԶՈՒ ներքին ծառայության կանոնագրքով և ՀՀ ԶՈՒ մարտական կանոնադրությամբ դրված պարտականությունները, որն անզգուշությամբ առաջացրել է ծանր հետևանքներ, այն է՝ Արցախի Հանրապետության պաշտպանության բանակի N զորամասի հրաձգային գումարտակի մի շարք զինծառայողներ զոհվել են, անհայտ կորել, գերեվարվել, ինչպես նաև ստացել տարբեր աստիճանի մարմնական վնասվածքներ:
Այս մասին հայտնում են Գլխավոր դատախազության մամուլի ծառայությունից։
Բացի այդ, Ի.Վ.-ն, ծառայողական դիրքով և կոչման բերումով հանդիսանալով նույն գումարտակի ժամկետային և կրտսեր սպայական կազմի ուղղակի պետը, 2020թ. հոկտեմբերի 10-ին՝ ժամը 12:00-ի սահմաններում, «Խուռհատ» սարի վրա տեղի ունեցած մարտի ժամանակ ինքնակամ լքել է մարտադաշտ հանդիսացող՝ վերոնշյալ տեղանքի մարտական դիրքերը:
21.02.2022 թվականին Ի.Վ.-ին մեղադրանք է առաջադրվել ՀՀ քրեական օրենսգրքի 375-րդ հոդվածի 4-րդ մասով և 380-րդ հոդվածի 1-ին մասով:
Վարույթն իրականացնող մարմնի կողմից քրեական գործը մեղադրական եզրակացությամբ 25.02.2022 թվականին ուղարկվել է հսկող դատախազին՝ այն հաստատելու և դատարան ուղարկելու համար:
Մինչդատական վարույթի օրինականության նկատմամբ հսկողություն իրականացնող դատախազի կողմից 28.02.2022 թվականին որոշում է կայացվել մեղադրական եզրակացությունը հաստատելու մասին և նույն օրը քրեական գործն ուղարկվել է Սյունիք մարզի ընդհանուր իրավասության դատարան:
Ծանուցում. ենթադրյալ հանցանքի մեջ կասկածվողը կամ մեղադրվողը համարվում է անմեղ, քանի դեռ նրա մեղավորությունն ապացուցված չէ ՀՀ քրեական դատավարության օրենսգրքով սահմանված կարգով` դատարանի` օրինական ուժի մեջ մտած դատավճռով:
