Ռուսաստանը լավ հաշվարկ է արել, թե ինչպես անի, որ իրավական գործընթացներն իրեն այդքան էլ չդիպչեն

Արևմտյան երկրները, համաշխարհային հանրությունն ագրեսոր են որակել Ռուսաստանին։ Մենք տեսնում ենք, որ այսօր նաև կոշտ տնտեսական պատժամիջոցների միջոցով են փորձում կանգնեցնել Ռուսաստանի գործողությունները։

Այս թեմայի մասին զրուցել ենք միջազգային իրավունքի մասնագետ Արա Ղազարյանի հետ։

Հարցին, թե Միջազգային իրավունքի տեսանկյունից ի՞նչ լծակներ կան՝ զսպելու ագրեսիան ու ագրեսորին, և որքանո՞վ է պաշտպանված ագրեսիայի ենթարկված երկիրը` մասնագետն ասաց. « Եթե վերցնենք ագրեսիան կամ ագրեսիայի ակտը, իրավական փաստաթղթերում դա մեծամասամբ որպես ինքնուրույն կատեգորիա չեն նշում։ Բայց կան բազմաթիվ այլ կատեգորիաներ, որոնք նույնպես միջազգային պատասխանատվության են ենթարկում պետություններին՝ դրանք պատերազմական հանցագործություններն են, մարդկության դեմ կատարվող հանցագործություններն են և ցեղասպանությունը, որոնք նույնպես կատարվում են ագրեսիայի արդյունքում։ Ագրեսիայի ակտի վերաբերյալ չկա Ռուսաստանի նկատմամբ կիրառվող իրավական հիմք, որովհետև Ռուսաստանը չի վավերացրել Միջազգային քրեական դատարանի կանոնադրությունը։ Հենց այդ բացից էլ ըստ էության օգտվում է Ռուսաստանը։

Ընդհանրապես Ռուսաստանը լավ հաշվարկ է արել, թե ինչպես անի, որ իրավական գործընթացներն իրեն այդքան էլ չդիպչեն։ Բայց բոլոր դեպքերում Միջազգային քրեական դատարանն սկսել է հետաքննություն, ոչ թե ագրեսիայի ակտի հիմքով, այլ պատերազմի հանցագործությունների և մարդկության դեմ հանցագործությունների հիմքով՝ կապված այս ռմբակոծությունների հետ։ Այնտեղ կան նաև մարդու իրավունքների զանգվածային խախտումներ, խոշտանգումներ, սպանություններ, անահամաչափ ուժի կիրառում, հումանիտար իրավունքի խախտում։ Սրանք բոլորը հանգեցնում են պատերազմական հանցագործությունների, մարդկության դեմ հանցագործության և ցեղասպանության, որը դրսևորվում է հենց ագրեսիայի ակտի եղանակով»։
