«Փաստ» օրաթերթը գրում է
Ոստիկանությունն առաջարկում է փոփոխություններ և լրացումներ կատարել «Վարչական իրավախախտումների վերաբերյալ» ՀՀ օրենսգրքում: Նախագծի մշակման գործընթացում ներգրավված է նաև Շրջակա միջավայրի նախարարությունը: Դրա ընդունմամբ ակնկալվում է նվազեցնել չնախատեսված տեղերում և վայրերում աղբ թափելու պրակտիկան՝ կիրառելով պատասխանատվության առավել գործուն ու կանխիչ մեխանիզմներ: Այն հնարավորություն կտա ավելի արագ հայտնաբերելու վարչական իրավախախտումը և բարձրացնելու հասարակության իրավագիտակցությունը շրջակա միջավայրը մաքուր պահելու հարցում:
Նախատեսվում է իրականացնել աղբավայրերի մոնիթորինգ, ինչը կնպաստի դրանց վնասակար ազդեցության նվազեցմանը։ Նախագծի ընդունման արդյունքում լրացուցիչ ֆինանսական միջոցների անհրաժեշտություն չի առաջանա, հակառակը, ինչպես ակնկալում է նախագիծը ներկայացնող մարմինը, պետբյուջեում եկամուտների էական ավելացում կլինի։ Մասնավորաբար, կարևորելով չսահմանված վայրերում սպառման թափոններ թափելու համար հասարակության պատասխանատվության բարձրացումը և իրավախախտումների արագ հայտնաբերումը, նախատեսվում է «Վարչական իրավախախտումների վերաբերյալ» օրենսգրքի 43.1 հոդվածի 3-4-րդ, 10-11-րդ մասերով նախատեսված վարչական իրավախախտումների համար պատասխանատվության միջոցների կիրառումը վերապահել նաև ՀՀ ոստիկանությանը: Հաջորդիվ` նախագծով աղբավայրը շահագործողների համար սահմանվում է նաև պատասխանատվության միջոց, որը կիրառվելու է աղբավայրի տարածքում կառավարության սահմանած կարգով մոնիթորինգ չիրականացնելու համար:
Նախատեսվում է նաև օրենսգիրքը լրացնել 43.2. հոդվածով և նշված հոդվածի 1-ին և 2-րդ մասերով նախատեսված վարչական իրավախախտումների համար պատասխանատվության միջոցների կիրառումը վերապահել շրջակա միջավայրի օրենսդրության կատարման նկատմամբ պետական վերահսկողություն (հսկողություն) իրականացնող տեսչական մարմնին: Միաժամանակ առաջարկվել է համապատասխան մեխանիզմներ մշակել համայնքում աղբակույտեր առաջանալու դեպքում համայնքի ղեկավարի նկատմամբ պատասխանատվության միջոց կիրառելու և օրենսգրքի համապատասխան հոդվածով սահմանված իրավախախտման հայտնաբերման այլընտրանքային միջոցներ նախատեսելու համար։
