Ծաղկաձորում հունիսի 27-28-ը տեղի է ունեցել կլոր սեղան-քննարկում` Հայաստանի Հանրապետության վարչական իրավախախտումների օրենսգրքի նախագծի շուրջ:

Աշխատանքային հանդիպմանը մասնակցել են ՀՀ արդարադատության նախարարի առաջին տեղակալ Արսեն Մկրտչյանը, ՀՀ արդարադատության նախարարի տեղակալ Արման Թաթոյանը, ԵԽ երևանյան գրասենյակի ներկայացուցիչ Լիլիթ Դանեղյանը, Սլովենիային Հանրապետության արդարադատության նախարարության քարտուղար Պիտեր Պավլինը, Իսպանիայի թագավորության Կոմպլուտենսեի համալսարանի դոկտոր, պրոֆեսոր Լորենա Բաքմայեր-Վինթերը, ԵՊՀ Սահմանադրական իրավունքի ամբիոնի և Քրեական իրավունքի ամբիոնի վարիչներ Գևորգ Դանիելյանը և Արա Գաբուզյանը, ոլորտի փորձագետներ, ինչպես նաև Արդարադատության նախարարության այլ աշխատակիցներ:

Արդարադատության նախարարի առաջին տեղակալ Արսեն Մկրտչյանը, ողջունելով աշխատանքային հանդիպման մասնակիցներին, շնորհակալություն է հայտնել Եվրոպայի խորհրդի երևանյան գրասենյակին նման ձևաչափով քննարկումներ կազմակերպելու և նախագծի վերաբերյալ ԵԽ փորձագետների եզրակացությունը տրամադրելու համար: «Հայաստանի Հանրապետության վարչական իրավախախտումների օրենսգրքի նախագիծն արդեն շրջանառվել է պետական մարմինների միջև, և, ստացված կարծիքներն ամփոփելով, կարծում եմ՝ կունենանք բավական որակյալ փաստաթուղթ»,- ասել է Արսեն Մկրտչյանը` երկօրյա հանդիպման մասնակիցներին մաղթելով արդյունավետ աշխատանք:

ԵԽ փորձագետներ Պիտեր Պավլինը և Լորենա Բաքմայեր-Վինթերը բարձր են գնահատել նախագծի աշխատանքային խմբի կատարած ծավալուն աշխատանքն ու, ներկայացնելով նախագծի վերաբերյալ իրենց եզրակացությունը, նշել են, որ վարչական իրավախախտումներին վերաբերող օրենսդրությունը պետք է լիարժեք կարգավորի բոլոր այն ընթացակարգերը, որոնցով պետք է իրականացվի արդարադատությունը և ապահովվի դրա կիրարկման տեսանելիությունը:

Սլովենիայի Արդարադատության նախարարության ներկայացուցիչ Պիտեր Պավլինն ընդգծել է, որ եզրակացությունում տեղ գտած մեկնաբանությունները բացառապես վերաբերում են եվրոպական չափանիշներին այդ դրույթների համապատասխանեցմանը, ինչպես նաև իրավական ոճի և համակարգման տեսանկյունից ապագա օրենքում անհրաժեշտ համարվող բարելավումներին:

Երկօրյա կլոր սեղան-քննարկման ընթացքում ԵԽ փորձագետներն ու նախագծի աշխատանքային խմբի անդամները, հոդված առ հոդված քննարկելով, իրենց դիտարկումներն ու մեկնաբանություններն են ներկայացրել նախագծի վերաբերյալ:

ԵՊՀ Սահմանադրական իրավունքի ամբիոնի վարիչ Գևորգ Դանիելյանը, ամփոփելով աշխատանքային հանդիպման արդյունքները, նշել է, որ քննարկումները օգտակար են եղել, իսկ ԵԽ փորձագետների գնահատականները՝ ոգևորիչ:

Քննարկումն իրականացվել է «Հայաստանի արդարադատության համակարգի անկախության, պրոֆեսիոնալիզմի և հաշվետվողականության ամրապնդումը» Եվրոպական միության և Եվրոպայի խորհրդի համատեղ ծրագրի շրջանակում:
