ՍԴ-ն կարճել է ԱԺ-ում լրագրողների մասնագիտական աշխատանքի սահմանափակումների վերաբերյալ ՄԻՊ դիմումը. գրասենյակը կշարունակի քննարկումները

Սույն թվականի փետրվարի 9-ին Մարդու իրավունքների պաշտպանը հրապարակել էր արտահերթ զեկույց՝ Ազգային ժողովում լրագրողների մասնագիտական աշխատանքի սահմանափակումների և լրագրողների նկատմամբ հանրային պաշտոնյաների անթույլատրելի արարքների մասին:
Խոսքն ավելի կոնկրետ վերաբերում էր լրագրողների գործունեության սահմանափակումներին ԱԺ նստավայրի տարածքում և շենքում գործող անվտանգության կանոնների ներքո սահմանելու իրավաչափությանը։ Զեկույցն ամրագրում է, որ գոյություն չունեն իրավական կոնկրետ ու հստակ կարգավորումներ, որոնցով կամ որոնց հիման վրա կամրագրվեն Ազգային ժողովում հավատարմագրված լրագրողների աշխատանքի առանձնահատկությունները ԱԺ նստավայրի տարածքում և շենքում։
ԱԺ-ում հավատարմագրված լրագրողների աշխատանքի սահմանափակումների՝ ՀՀ Սահմանադրությանը համապատասխանության հարցով Մարդու իրավունքների պաշտպանը դիմել էր նաև Սահմանադրական դատարան. վիճարկվել էր «Ազգային ժողովի կանոնակարգ» ՀՀ սահմանադրական օրենքի 5-րդ հոդվածի 2-րդ մասի, 14-րդ հոդվածի 7-րդ մասի, 54-րդ հոդվածի 4-րդ մասի համապատասխանությունը ՀՀ Սահմանադրության 42-րդ, 51-րդ, 75-րդ, 78-րդ, 79-րդ և 81-րդ հոդվածներին:
Մարտի 29-ին ՍԴ-ն գործի վարույթը կարճեց՝ փաստելով, որ դիմումի շրջանակներում վկայակոչված վերոնշյալ դիրքորոշումները չունեն սահմանադրաիրավական վեճի բովանդակություն, հետևաբար` Դիմողի կողմից չեն առաջադրվել Սահմանադրական դատարանի քննությանը ենթակա հարցեր:
ՄԻՊ Հանրային կապերի բաժնից, 1or.am-ի հարցմանն ի պատասխան, հայտնեցին, որ ՍԴ-ի որոշմանը պաշտպանի գրասենյակում արձագանքել են ինչպես Սահմանադրական դատարանի ցանկացած որոշման՝ հարգանքով և ի գիտություն ընդունելով:
«Հետագա քայլերի մասով Պաշտպանի հաստատությունն իր մանդատի շրջանակներում շարունակելու է քննարկումները թե՛ ԱԺ պատգամավորների ու նախագահի, և թե՛ հավատարմագրված լրագրողների հետ համատեղ աշխատանքի արդյունավետ ձևերի ընտրության նպատակով»,- ասաց ՄԻՊ մամուլի խոսնակ Էդգար Այվազյանը:
