Փոփոխություններ և լրացումներ՝ «Պետական կենսաթոշակների մասին» և «Պետական նպաստների մասին» օրենքներում

«Պետական կենսաթոշակների մասին» և «Պետական նպաստների մասին» օրենքներում լրացումներ և փոփոխություններ կատարելու վերաբերյալ նախագծերն այսօր երկրորդ ընթերցմամբ և ամբողջությամբ ընդունվել են Ազգային ժողովի կողմից։

Այս մասին հայտնում են աշխատանքի և սոցիալական հարցերի նախարարությունից:

Ըստ այդմ, լուծվում են կենսաթոշակային օրենսդրության իրավակիրառ պրակտիկայում ծագած մի շարք խնդիրներ, հստակեցվում են որոշ ձևակերպումներ, իսկ առանձին դեպքերում կատարվում են խմբագրական բնույթի որոշ փոփոխություններ։

Մասնավորապես՝ «Պետական կենսաթոշակների մասին» օրենքում լրացումներ և փոփոխություններ կատարելու մասին» օրենքով, ի թիվս այլ կարգավորումների, սահմանվել է հետևյալը՝

  • զինծառայողի 20 և ավելի տարվա զինվորական ծառայության ստաժ ունենալու պարագայում հաշմանդամության և կերակրողին կորցնելու դեպքում զինվորական կենսաթոշակներն այսուհետ կհաշվարկվեն զինծառայության փաստացի ստաժից (ներկայումս հաշվարկվում է զինծառայության 20 տարվա ստաժից)։
  • Աշխատանքային կենսաթոշակի իրավունք տվող ստաժի առկայության դեպքում աշխատանքային ստաժում կհաշվառվի հաշմանդամ երեխային մինչեւ նրա 18 տարին լրանալը խնամելու ամբողջ ժամանակահատվածը (ներկայումս հաշվառվում է առավելագույնը՝ 10 տարի)։
  • Կենսաթոշակն անկանխիկ եղանակով ստացող կենսաթոշակառուի՝ Հայաստանի Հանրապետությունում լինելն այսուհետ կհաստատի նաև կենսաթոշակ նշանակող ստորաբաժանումը (ԱՍՀՆ Միասնական սոցիալական ծառայությունը)՝ անձամբ կենսաթոշակառուի ներկայացրած՝ կենսաթոշակին առնչվող ցանկացած գրավոր դիմումի հիման վրա (ներկայումս հաստատում է միայն վճարող կազմակերպությունը՝ բանկը կամ Հայփոստը)։
  • Կենսաթոշակ ստանալու իրավունքը չի դադարեցվի, այսինքն՝ կենսաթոշակի վճարումը կշարունակվի ոչ միայն զորահավաքային զինվորական ծառայության ներգրավվելու, այլ նաև վարժական հավաքի կանչվելու դեպքերում։
  • Հաշմանդամության և կերակրողին կորցնելու դեպքում զինվորական կենսաթոշակների չափերը չեն կարող պակաս լինել, համապատասխանաբար, պարտադիր ժամկետային զինվորական ծառայության շարքային կազմի զինծառայողի հաշմանդամության զինվորական կենսաթոշակի և պարտադիր ժամկետային զինվորական ծառայության շարքային կազմի մահացած (զոհված) զինծառայողի ընտանիքի անդամի կերակրողին կորցնելու դեպքում զինվորական կենսաթոշակի չափից:

 Ի թիվս վերոնշյալ փոփոխությունների՝ Կառավարությանը վերապահվել է  լիազորություն՝ «Եվրասիական տնտեսական միության անդամ պետությունների աշխատողների կենսաթոշակային ապահովության մասին» համաձայնագրի կիրարկումն ապահովելու համար։
