Aravot.am-ի զրուցակիցն է «Համախմբում» նախաձեռնության անդամ, կալանքի տակ գտնվող Ավետիք Չալաբյանի փաստաբան Արթուր Հարությունյանը

– Պարզ դարձավ, որ Ավետիք Չալաբյանի հետ առերեսման ժամանակ Թոռնիկ Ալիյանը հրաժարվել է իր նախաքննական ցուցմունքից, սակայն, դա չխանգարեց, որ դատարանը Չալաբյանին երկու ամսով կալանավորելու որոշում կայացնի: Ինչպե՞ս եք բնութագրում ստեղծված իրավիճակը, ինչի՞ մասին է Ավետիք Չալաբյանի գործն, ընդհանրապես:

– Մեղադրանքի հիմքում դրվել է ընդամենը մեկ մոնտաժված և օրենքի իմաստով անթույլատրելի ապացույց հանդիսացող գաղտնի ձայնագրություն և, անգամ այդ ձայնագրության մեջ, Ավետիք Չալաբյանը հավաքներին մասնակցելու նպատակով նյութական շահագրգռվածություն առաջարկելու վերաբերյալ որևէ  պնդում կամ միտք չի արտահայտում։  Գործում առկա չէ որևէ ցուցմունք, որով կհաստատվեր հիմնավոր կասկածն առ այն, որ Ավետիք Չալաբյանը հնարավոր է կատարած լինի իրեն ապօրինաբար մեղսագրվող արարքը։ Այո, ճիշտ նշեցիք՝ նույնիսկ Թոռնիկ Ալիյանն առերես հարցաքննության ժամանակ պնդել է, որ Ավետիք Չալաբյանը երբեք իրեն գումար կամ այլ նյութական շահ չի առաջարկել հավաքներին մասնակցելու համար։ Ահա այս պայմաններում Ավետիք Չալաբյանին անօրինական կալանավորել են։

– Ինչո՞վ է պայմանավորված Ավետիք Չալաբյանի նկատմամբ նման «հատուկ» վերաբերմունքը:

– Ավետիք Չալաբյանի նկատմամբ կատարվողը, մեր գնահատմամբ, հանդիսանում է մաքուր քաղաքական հետապնդում, քանի որ նրան կալանավորել են մի արարքի համար, որը հուլիսի մեկից ուժի մեջ մտնող նոր քրեական օրենսգրքով չի հանդիսանում հանցագործություն, ուստի օրենսգրքի ուժի մեջ մտնելու պահից՝ Ավետիք Չալաբյանի նկատմամբ իրականացվող քրեական հետապնդումն, իրավունքի ուժով, ենթակա է դադարեցման։ Այս պայմաններում ենթադրել, թե Ավետիք Չալաբյանը կխուսափեր քննությունից, կխոչընդոտեր քննությանը՝ կամ որևէ մեկի հիվանդ երևակայությունն է, կամ էլ՝ հատուկ իրականացվող պատժիչ գործողություն։ Ինչ վերաբերվում է այդպիսի ճնշման քաղաքական նպատակներին, թույլ տվեք չանդրադառնալ դրանց բովանդակությանը, քանի որ դա դուրս է իմ մասնագիտական գործունեության շրջանակից։

– Հայտարարել եք, որ բողոքարկելու եք կալանավորման որոշումը. ի՞նչ հիմքերով եք բողոքարկելու և ի՞նչ ակնկալիքներ ունեք դատարանից:

-Այո, իհարկե բողոքարկելու ենք, սակայն այս գործի տարօրինակություններից մեկն էլ այն է, որ մենք դեռևս չենք ստացել դատարանի որոշում, ուստի դեռ չունենք այն փաստարկները, որոնց պետք է անդրադառնանք վերաքննիչ բողոքում։ Վերաքննիչ քրեական դատարանից, բնականաբար ունենք անաչառ քննության ակնկալիք, սակայն իրականցվողն արդեն մեզ հուշում է, որ միգուցե մեր ակնկալիքները չափազանցված են։
