Երբ ոստիկանության համազգեստով անձը ակնհայտ ապօրինություն է կատարում նա դադարում է ոստիկան լինել։ Այս մասին Facebook-ի իր էջում գրել է «Հայրենիք» կուսակցության քաղխորհրդի անդամ, Արսեն Բաբայանը, արձագանքելով ավտոերթի մասնակիցների նկատմամբ ոստիկանների այսօրվա գործողություններին:

Նա, մասնավորապես, նշել է. «Երբ այդ անձը կատարում է քրեական օրենսգրքով արգելված արարք, այսինքն՝ հանցագործություն, նա դառնում է ոստիկանի համազգեստ հագած հանցագործ։

Քրեական օրենսգրքում մի շարք հոդվածներ կան, որոնք լիարժեք համապատասխանում են այն գործողություններին, որոնք այսօր կատարել են որոշ ոստիկաններ, դրանցից են՝ մարդուն ապօրինի ազատությունից զրկելը, նույն գործողությունը, որը կատարվել է մի խումբ անձանց կողմից նախնական համաձայնությամբ (մի խումբ ոստիկանի համազգեստով անձինք նախնական համաձայնությամբ են կատարել), կյանքի կամ առողջության համար վտանգավոր բռնություն գործադրելով կամ դա գործադրելու սպառնալիքով (մի խումբ ոստիկանի համազգեստով անձին հենց այդպես էլ կատարել են), անչափահասի նկատմամբ, երկու կամ ավելի անձանց նկատմամբ (մի խումբ ոստիկանի համազգեստով անձինք նույն վայրից առևանգել են մի խումբ անձանց), կատարվել են կազմակերպված խմբի կողմից (ոստիկանության համազգեստ հագած կազմակերպված խմբով են կատարել)։

Քրեական օրենսգրքում կա նաև կողոպուտը, այն է՝ ուրիշի գույքի բացահայտ հափշտակությունը (ոստիկանի համազգեստով անձինք այսօր կատարել են նաև այդպիսի արարք), կողուպոտը, որը կատարվել է կատարվել է մի խումբ անձանց (ոստիկանի համազգեստով) կողմից նախնական համաձայնությամբ, կատարվել է առանձնապես խոշոր չափերով (ավտոմեքենա), կազմակերպված խմբի կողմից (ոստիկանի համազգեստով մարդիկ ակնհայտ կազմակերպված կատարում էին կողուպուտ) և բազմաթիվ այլ հանցավոր արարքներ, որոնց այսօր ականատես եղանք։

Քրեական օրենսգիրքը մարդուն թույլատրում է անհրաժեշտ պաշտպանության դիմելու միջոցով պաշտպանվել հանցավոր ոտնձգություններից։ Բոլոր այն դեպքերում, երբ ոստիկանի համազգեստ հագած մարդն իրեն թույլ է տալիս հանցագործություն, ապա քաղաքացին էլ իրավունք ունի դիմելու անհրաժեշտ պաշտպանության։

Ոստիկանության բարձրագույն ղեկավար կազմին նախազգուշացնում եմ, որ ձեր ապօրինի գործունեությունը կարող է բերել հանրային անկառավարելիության և ֆիզիկական վնասվածքների։ Ձեր ակնհայտ ապօրինի, հաճախ՝ նաև հանցավոր վարքագիծը կարող է թողնել անդառնալի հետևանքներ նախ ձեր համար, հետո շատ անձանց։

Խստագույն ձեզ զգուշացնում եմ, քանի դեռ ուշ չէ խելքի եկեք։ Դադարեցրեք թրքաբարո դուրսպրծուկին ծառայելը։ Դուք պարտավոր եք ծառայել Հայաստանի Հանրապետությանը, հանրային շահին ու Հայրենիքին։ Մի անցեք ձեր չափերը, հետո ուշ կլինի»։
