Իրավական «բեսպրեդել» Ավետիք Չալաբյանի գործով

«ԱՐԱՐ» հիմնադրամի համահիմնադիր, հասարակական-քաղաքական գործիչ Ավետիք Չալաբյանի գործը իրականացվում է ընթացակարգային և բովանդակային խախտումներով. նրա պաշտպանական խումբն է հանդես եկել հայտարարությամբ: Ի վերջո փաստաբաններին հաջողվել է ստանալ վերաքննիչ քրեական դատարանի դատավոր Արմեն Դանիելյանի կայացրած որոշումը, որով Ավետիք Չալաբյանի նկատմամբ կիրառված խափանման միջոց կալանավորումը թողնվել էր անփոփոխ։
Փաստաբաններն արձանագրում են, որ Ավետիք Չալաբյանին անհիմն առանց որևէ արժանահավատ ապացույցի, քրեադատավարական ընթացակարգերի կոպտագույն խախտումներով մեղադրում են քրեական օրենսգրքի մի հոդվածով, որն արդեն հուլիսի 1-ից ապաքրեականացված է։ Ըստ էության, գործող իշխանությունները Ավետիք Չալաբյանին հետապնդում են և կալանավորում մի հոդվածով, որով արդեն հուլիսի 1-ից որևէ մեկին չեն կարող նույնիսկ դատապարտել։ Փաստաբանները փաստում են, որ վերաքննիչ քրեական դատարանի դատավորը պարզապես պատճենել է ընդհանուր իրավասության դատարանի դատավորի տեքստը, վերջինս էլ պատճենել էր քննիչի միջնորդությունից։
Դատարանները փաշինյանական իշխանության օրոք դարձել են քննիչների ձեռքին վճիռ դակող խամաճիկներ և հանուն գործող վարչախմբի, իրավաբանական կոպտագույն խախտումներ են իրականացնում։ Չալաբյանի գործով նաև փաստաբանները փաստում են, որ նրան հնարավոր չէր լինի կալանավորել կոնկրետ քրեական օրենսգրքի 163 հոդվածի 2-րդ մասով, մեղադրանք են առաջադրել հոդվածի 3-րդ մասի 2-րդ կետով, որը վերաբերում է 2 և ավելի անձանց նյութապես շահագրգռելուն, մինչդեռ նախաքննությունը իրականացնող մարմինը չունի ոչ մի ապացույց, ընդամենը մեկ անձի՝ Ագրարային համալսարանի ուսխորհրդի նախագահ Թոռնիկ Ալիյանի ցուցմունքն է։ Վերջինս ինքն է փորձել սադրել Ավետիք Չալաբյանին իրեն նյութապես շահագրգռելու, սակայն հրապարակված ձայնագրության մեջ էլ փաստվում է, որ հասարակական-քաղաքական գործիչը որևէ կերպ չի տրվել սադրանքների։ Այդուհանդերձ իշխանությունը ամեն գնով հասարակական-քաղաքական գործչին կալանավորելու իր մոլուցքի մեջ խախտում է հնարավոր բոլոր օրենքները։
Նույն հաջողությամբ Ավետիք Չալաբյանին կարող էին մեղադրել լավ կրթություն ունենալու մեջ։ Այդպիսի հոդված էլ չկա քրեական օրենսգրքում, բայց դա քիչ կհետաքրքրի գործող ապիկար վարչախմբին։ Ինչևէ փաստենք, որ գործ ունենք հերթական ապօրինության հետ, որի կազմակերպիչներն ու իրականացնողները վաղ թե ուշ իրենք են կանգնելու դատարանի առաջ՝ ակնհայտ անմեղ մարդուն զրպարտելու համար։
