Հուլիսի 1-ից ուժի մեջ մտնող Քրեական օրենսգրքում այն հոդվածը, որով քրեական հետապնդման է ենթարկվում Ավետիք Չալաբյանը, որպես այդպիսին հանցագործություն նախատեսված չէ: Հուլիսի 1-ի դրությամբ Ա. Չալաբյանը պետք է, ըստ էության, կալանքից ազատ արձակվի, որովհետև նրա արարքն այլևս չի կարող համարվել քրեորեն հետապնդելի արարք։
Մինչ մեկուկես ամիս կալանքի տակ գտնվող ընդդիմադիր գործչի փաստաբանները հայտարարում են, թե իրենց պաշտպանյալին վերագրվող արարքը նոր քրեական օրենսգրքում չկա, հետևաբար մեղադրանքը պետք է հանվի, Արդարադատության նախարարությունը շտապում է հերքել՝ նշելով, թե իբր քրեական նոր օրենսգրքում լրացումներ են կատարվել, և Չալաբյանին վերագրվող արարքը հուլիսի 1-ից հետո էլ շարունակելու է հանցագործություն համարվել։
Հասարակական գործիչ, ՀՀ սահմանադրական դատարանի աշխատակազմի նախկին ղեկավար Էդգար Ղազարյանի խոսքով՝ գաղտնալսումն օրենքով արգելված է, և դրա արդյունքում ձեռք բերված տեղեկատվությունը երբեք չի կարող համարվել օրինական ճանապարհով ձեռք բերված աղբյուր՝ հանցագործությունը բացահայտելու համար.
«Ես Արդարադատության նախարարությունը հայտարարության վերաբերյալ ոչինչ չեմ կարող ասել, տեղյակ եմ միայն Չալաբյանի փաստաբանական խմբի հայտարարությանը, ովքեր վստահաբար պնդում են, որ ամենաուշը հուլիսի 1-ին Ավետիք Չալաբյանը կլինի ազատության մեջ:
Էլ չեմ խոսում այն մասին, որ Գագիկ Ջհանգիրյանն էլ իր հայտարարությամբ կասկածի տակ է դնում Ավետիք Չալաբյանի նկատմամբ իրականացվող քրեական հետապնդման օրինականությունը»,- 1or.am-ի հետ զրույցում ասաց Ղազարյանը:
