«Փաստ» օրաթերթը գրում է
«Համախմբում» շարժման անդամ, հասարակական-քաղաքական գործիչ Ավետիք Չալաբյանը շարունակում է մնալ կալանքի տակ: Նրան մեղսագրվում է ՀՀ քրեական օրենսգրքի 163-րդ հոդվածի 3-րդ մասի 2-րդ կետով նախատեսված արարքը, որն արդեն ընդունված և հուլիսի 1-ից ուժի մեջ մտնող քրեական օրենսգրքով ապաքրեականացված էր: Սակայն դատական նիստերից մեկի ժամանակ դատախազի կողմից ասվել էր, թե օրենսդրական նախաձեռնություն է իրականացվում, որ այդ արարքը նորից քրեականացվի: Փաստաբան Վարազդատ Հարությունյանը «Փաստի» հետ զրույցում նշում է` փոփոխություններն արդեն իսկ արել են հատուկ Չալաբյանի համար:
«Քրեական նոր օրենսգրքում փոփոխությունները նախաձեռնել և գաղտագողի արել են` առանց հանրային քննարկման, առանց որևէ ընթացակարգային պահանջի պահպանման: Փոփոխությունը երկրորդ ընթերցմամբ ընդունվել է, բայց դեռևս չի ստորագրվել նախագահի կողմից»,-ասում է նա` ընդգծելով, որ, իրենց գնահատմամբ, այս փոփոխությունն արվում է բացառապես մեկ` Ավետիք Չալաբյանին կալանքի տակ ավելի երկար պահելու նպատակով:
Օրերս Երևան քաղաքի ընդհանուր իրավասության առաջին ատյանի դատարանում քննվում էր Չալաբյանի փաստաբանական խմբի բողոքը դատախազի՝ Ավետիք Չալաբյանի խափանման միջոցը փոխելու վերաբերյալ ՀՀ ԱԺ պատգամավորներ Սեյրան Օհանյանի, Իշխան Սաղաթել յանի, Էլինար Վարդանյանի, Հայկ Մամիջանյանի, Տիգրան Աբրահամյանի, ՀՀ նախկին փոխվարչապետ Վաչե Գաբրիել յանի և «Արար» հիմնադրամի երաշխավորությունները մերժելու որոշումը։ Դատարանը հետաձգել էր գործի քննությունը՝ դատախազի մասնակցությունն ապահովելու համար և հաջորդ նիստը նշանակել հուլիսի 21-ին:
«Այդ նիստից առանձնապես ակնկալիքներ չկան: Հուսով ենք` մինչ այդ խափանման միջոցի հարցով հանգուցալուծում կլինի: Հուլիսի 12-ին ավարտվելու է կալանքի երկամսյա ժամկետը: Ստացվում է` քննիչը պետք է դատարան մտնի երկարացման միջնորդությամբ: Հուսով ենք, որ չի երկարացվի»,-եզրափակեց Ավետիք Չալաբյանի փաստաբան Վարազդատ Հարությունյանը:
