Հրատապ հաղորդագրություն.Ավետիք Չալաբյանի գործով քննիչն ու դատախազը կոպտորեն խախտում են քրեական դատավարության օրենսգրքով սահմանված ընթացակարգը՝ նրան ապօրինաբար անազատության մեջ պահելու համար

Ինչպես հիշում եք, երեկ՝ հուլիսի 10-ին, դատավոր Արուսյակ Ալեքսանյանը մասնակի բավարարեց քննիչի միջնորդությունը, և մեր պաշտպանյալի ապօրինի կալանքի ժամկետն ապօրինաբար երկարացրեց ևս 15 օրով։ Մենք նաև ասել էինք, որ դա արվում է զուտ այն բանի համար, որպեսզի քննիչն ու դատախազը հասցնեն գործն ուղարկել դատարան՝ Չալաբյանի կալանքի պայմաններում։ Հակառակ դեպքում, եթե Չալաբյանը հուլիսի 12-ին հայտնվեր ազատության մեջ, ապա գործը դատարան ուղարկելու դեպքում դատարանը կալանքի հարց չէր քննարկելու։
Այդ նույն թաքնված նպատակից ելնելով՝ երեկ քննիչը, կոպտորեն խախտելով ՀՀ քրեական դատավարության օրենսգրքով նախատեսված պատշաճ ծանուցման կարգն ու ժամկտները, ուղարկել է ծանուցում առ այն, որ այսօր՝ 12։00-ին "Արմավիր" ՔԿՀ-ում իրականացնելու է վարույթային գործողություն՝ գործի նյութերի ծանոթացում։
Նշենք, որ միայն այս գործողությունից հետո կարող է քննիչը մեղադրական եզրակացությունն ուղարկել հսկող դատախազին՝ այն հաստատելու և դատարան ուղարկելու միջնորդությամբ։
Եթե քննիչը պահպաներ օրենքով նախատեսված՝ ծանուցման առնվազն 2-օրյա ժամկետը, ապա վարույթն իրականացնող մարմինը միևնույնն է չէր հասցնելու գործն ուղարկել դատարան, քանի որ չէր կարողանալու ապահովեր կալանքի ժամկետի ավարտից ամենաուշը 15 օր առաջ գործը դատարան ուղարկելու պայմանը։
Բոլոր լրատվամիջոցների, իրավապաշտպան կազմակերպությունների և անձանց, միջազգային կառույցների ուշադրությունն ենք հրավիրում այս աղաղակող ամենաթողության և անօրինականության փաստի շուրջ։ Կից ներկայացնում ենք քննիչին և Երևան քաղաքի դատախազին ուղղված մեր գրության լուսապատճենը՝ իրավական և փաստական բոլոր հիմնավորումներով։
Հիշեցնենք, որ «Համախմբում» շարժման անդամ, հասարակական-քաղաքական գործիչ Ավետիք Չալաբյանին անհիմն, առանց որևէ արժանահավատ ապացույցի և քրեադատավարական ընթացակարգերի կոպտագույն խախտումներով մեղսագրվում է ՀՀ քրեական օրենսգրքի 163-րդ հոդվածի 3-րդ մասի 2-րդ կետով նախատեսված արարքը։
«Ես կալանավորվել եմ շինծու քրեական գործով, որում բացակայում է որևէ իրական հանցակազմ և որի միակ իրական նպատակն ինձ և ընկերներիս վրա անթաքույց քաղաքական ճնշում գործադրելն է: Բոլոր ինձ ճանաչողները հրաշալի գիտեն, որ ես չեմ կատարել որևէ ապօրինի արարք կամ նույնիսկ գործողություն, որը կարող էր հակասել մեր արժեհամակարգին: Որևէ քաղաքական ճնշում, ակնհայտ մեքենայությունների վրա հիմված որևէ քրեական գործ չեն կարող շեղել ինձ մեր երկրի ու պետականության համար մղվող պայքարից»,-կալանավայրից իր հայտարարությունում նշել էր Ավետիք Չալաբյանը: Ավետիք Չալաբյանի ազատության համար ամիսներ շարունակ պայքարում են լայն հասարակության տարբեր խմբեր` ակցիաներով, ստորագարահավաքներով և օրենքով սահմանված բոլոր միջոցներով կոչ անելով ազատել Ավետիք Չալաբյանին:
