Ամերիկահայ իրավաբանները պահանջում են ազատ արձակել Ավետիք Չալաբյանին

Լոս Անջելեսում գործող հայ-իրավաբանական ասոցիացիան հայտարարություն է տարածել՝ կոչ անելով պատշաճ իրավական գործընթաց և օրենքի գերակայություն ապահովել «Արար» հիմնադրամի համահիմնադիր, հասարակական-քաղաքական գործիչ Ավետիք Չալաբյանի գործով։ Ամերիկահայ իրավաբանները նշում են, որ Չալաբյանն առաջին անգամ մեղադրվում է ոչ բռնի գործով, իսկ նրա 2 ամսից ավելի տևած կալանքը վկայում է օրենքի նկատմամբ վրդովեցուցիչ արհամարհանքի մասին։
Հայաստանի քրեադատավարական օրենսգրքով թույլատրվում են խափանման միջոցի այլընտրանքային ձևեր. ինչպես օրինակ գրավը, տնային կալանքը, կամ տեղաշարժման, ազատության սահմանափակումը, ինչը շատ ավելի ողջամիտ կլիներ Ավետիք Չալաբյանի գործով։
Հայ իրավաբաններն արձանագրում են, որ Ավետիք Չալաբյանի դեպքում գործ ունենք քաղաքական ենթատեքստի հետ, հատկապես որ մեղադրող կողմը չի ներկայացրել պատշաճ ապացույցներ, իսկ դատարանը չի կարողացել ձևակերպել որևէ ողջամիտ բացատրություն՝ նրան կալանքի տակ պահելու համար։
Ասոցիացիան ընդգծում է, որ Ավետիք Չալաբյանի գործը եզակի չէ Հայաստանում վերջին տարիներին ձևավորված իրավական պրակտիկայում։ Գնալով ավելի ու ավելի շատ մասնագետներ՝ հատկապես Սփյուռքում, իրենց վրդովմունքն են արտահայտում «Արար» հիմնադրամի համահիմնադիր, հասարակական-քաղաքական գործիչ Ավետիք Չալաբյանի հետ տեղի ունեցող գործընթացների կապակցությամբ, նշում, որ այն ինչ կատարվում է Հայաստանում, որևէ կապ չունի օրենքի հետ, և ընդամենը անձնական վրեժխնդրություն է այն մարդկանց նկատմամբ, ովքեր ընդդիմադիր հայացքներ ունեն։
Նշենք, որ գրեթե բոլորը, ովքեր ծանոթանում են այս գործին իրենց զարմանքն ու վրդովմունքն են արտահայտում հայտնի հասարակական-քաղաքական գործչի դեմ փաշինյանական վարչախմբի իրականացրած բռնաճնշումներից: Այն ինչ կատարվում է «Արար» հիմնադրամի համահիմնադրի հետ կարող է կատարվել ցանկացածի նկատմամբ, և հենց այդ պատճառով էլ այս գործը ավելի քան ցուցիչ է, թե ինչ է իրականում կատարվում Հայաստանում, եթե ազդեցիկ և մեծ հեղինակություն վայելող գործչի հետ են իրականացնում այս անարդարացի հետապնդումը, ապա Հայաստանի յուրաքանչյուր քաղաքացի կարող է իրեն անպաշտպան զգալ։
