Քաղաքական պատվերի և բարոյականության ու օրենքի գերակայության դիլեման

Հայաստանում քաղաքական բռնաճնշումները գնալով նորանոր «բարձունքներ» են նվաճում։ Եվ ընդդիմադիրներին թիրախավորելու նպատակով իշխանություններն իրենց ձեռքին գործիք են դարձրել իրավապահ և դատական համակարգը։ Պատահական չէ, որ արդարադատությունն ու օրինականությունն ապահովելու՝ իրենց հիմնական առաքելությունն իրականացնելու փոխարեն իրավապահներն ու դատարանները զբաղված են ընդդիմադիրների վրա գործեր «կարելով» ու, առավել ևս, մարդկանց «փակելով»՝ այդ ճանապարհին կալանքը կիրառելով որպես պատ-իչ գործիք։
Փաստացի կարող ենք ասել, որ այսօրվա իշխող քաղաքական ուժը շարունակում է դատական իշխանության անկախության նշույլները վերացնելու և իրենից կախվածության մեջ գցելու քաղաքականությունը, որը գործի է դրվում քաղաքական մրցակիցներին լռեցնելու, շանտաժի ենթարկելու, վարկաբեկելու և անազատության մեջ պահելու համար։
Այստեղ, սակայն, հատկապես իրավապահ ու դատական համակարգերի ներկայացուցիչների համար առաջ է գալիս պայքարը մի կողմից՝ բարոյականության, արժանապատվության, օրենքի գերակայության, իսկ մյուս կողմից էլ՝ իշխանությունների կողմից իջեցված պատվերները կյանքի կոչելու միջև։ Օրինակ՝ ակնհայտ է՝ դատական համակարգի յուրաքանչյուր ներկայացուցիչ հասկանում է, որ և՛ բարոյականության տարրական նորմերի, և՛ օրենքի տեսանկյունից Ավետիք Չալաբյանին կալանավորելը ոչ մի բարոյական և իրավականի չափանիշի չի համապատասխանում։ Գործի քաղաքական բնույթը և իրավականության տեսանկյունից հիմնազուրկ լինելը բոլորի համար է պարզ, բայց մյուս կողմից էլ նրան կրկին կալանավորելու իշխանությունների պատվերի հարցն է դրված։
Այսինքն, կազուսային իրավիճակ է ստացվում, որ կշեռքի մի նժարին դրված է բարոյականությունը և օրենքի գերակայությունը, իսկ մյուս նժարին՝ քաղաքական պատվերը։ Եվ այս իրողությունը լակմուսի թղթի նշանակություն կարող է ունենալ առաջին հերթին արդարադատությունն իրականացնող մարմինների՝ մասնավորապես դատավորների համար։
Եվ նրանք պետք է իրենց համար որոշում կայացնեն, թե որ ճանապարհով են գնում՝ պատվերի կատարմա՞ն, թե՞ բարոյականության և օրենքի գերակայության։ Տեսնենք՝ որ կողմը կհաղթի...
