Դատավոր Մացոյի նոր ապօրինությունները․ Ավետիք Չալաբյանը ոչ թե կալանավոր է, այլ՝ պատանդ

«ԱՐԱՐ» հիմնադրամի համահիմնադիր, հասարակական-քաղաքական գործիչ Ավետիք Չալաբյանը ոչ թե կալանավոր է, այլ այս երկրում գործող վարչախմբի պատանդ, այդ մասին նա ինքն է ասել երեկ Երևանի ընդհանուր իրավասության դատարանում դատաքննության ժամանակ։
Տխրահռչակ Մնացական Մարտիրոսյանն այդպես էլ չէր կողմնորոշվում, թե ինչպե՞ս իրականացնի դատաքննությունը։ Սկզբից ապացույցները հետազոտի՞, հետո՝ վկաներին, թե՞ հակառակը։ Ի վերջո բուռն քննարկումներից հետո Մնացական Մարտիրոսյանը կրկին որոշում կայացրեց՝ հակադրվելով Չալաբյանի փաստաբաններին։
Նա որոշեց, որ պետք է անցնել ապացույցների հետազոտման փուլին, ապա հարցաքննել Ավետիք Չալաբյանի փաստաբանների կողմից միջնորդած երկու վկաներին։
Ինքը՝ Չալաբյանը, իր ելույթում նշեց, որ ծանոթացել է դատարանի որոշմանը՝ իրեն կրկին կալանավորելու մասին, և դրա մեջ որևէ փաստական հիմք վկայակոչված չէ։
«Դուք ինձ անձնական ազատությունից զրկել եք առանց վկայակոչելու որևէ փաստական հիմք, չկա ոչինչ բացի ձեր սուբյեկտիվ վերլուծությունից»,- ասել է Չալաբյանը և ընդգծել, որ ոչ թե կալանավոր է, այլ գործող վարչախմբի պատանդ։
«Ունենալով պատանդի կարգավիճակ՝ ես այցելելու եմ դատական լսումների միայն մեկ նպատակով, ես այս դատարանի իրավազորությունը չեմ կարող ընդունել, սակայն այցելում եմ այս լսումներին, որպեսզի հասարակությանը ներկայացնեմ իմ անմեղության բոլոր ապացույցները»,- ասել է Չալաբյանը։
Մնացական Մարտիրոսյանին, կարծես, նրա պնդումները բացարձակապես չէին հետաքրքրում։ Դատավորը, որը տասնամյակներ շարունակ հայտնի է հնարավոր բոլոր քաղաքական գործերով, այդ թվում ժամանակին դատել էր վարչապետի պաշտոնը զբաղեցնող Նիկոլ Փաշինյանին, այսօր էլ նույն եռանդով դատում է ցանկացածին, իրականացնում այնպիսի ապօրինություններ, որոնք աննախադեպ են ոչ միայն հայկական իրավակիրառ պրակտիկայում, այլ նաև կարող են ցնցել աշխարհի յուրաքանչյուր բռնապետական երկրի ցանկացած իրավաբանի։
Ինքը՝ Չալաբյանը, վստահաբար նշում է, որ որևէ կերպ կաշկանդված չլինելով կալանքով, շարունակելու է իր պայքարը առանց հանգստի և թուլանալու։ Եվ հենց այս հանգամանքն է, որ մտահոգում է իշխանություններին: Նրանք այդպես էլ չկարողացան և ի վիճակի չէին կոտրելու Ավետիք Չալաբյանի դիմադրությունը։
