Ավետիք Չալաբյանի դատաքննության հարցով շտապում են

Երևանի Ընդհանուր իրավասության դատարանի տխրահռչակ դատավոր Մնացական Մարտիրոսյանը վերջին նիստում մերժել է «ԱՐԱՐ» հիմնադրամի համահիմնադիր, հասարակական-քաղաքական գործիչ Ավետիք Չալաբյանի պաշտպանների միջնորդությունը։
Նշենք, որ Չալաբյանի դեմ քրեական գործ է հարուցվել Քրեական օրենսգրքի 163-րդ հոդվածի 3-րդ մասի 2-րդ կետի հատկանիշներով։ Ավելի վաղ Չալաբյանի դեմ մեկ այլ հոդվածով էր քրեական գործ հարուցվել, սակայն Նոր օրենսգրքի ուժի մեջ մտնելու հետ կապված այդ հոդվածն ապաքրեականացվել էր։
Գործող իշխանությունները արագ, գերգաղտնի օպերացիա են իրականացրել, Քրեական օրենսգրքում մեկ այլ հոդված էին տեղադրել, որի վերաբերյալ որևէ մեկն այդպես էլ տեղեկություն չունի, թե ինչպե՞ս է դա ընդունվել, ի՞նչ պայմաններում։ Չալաբյանի փաստաբաններն առաջարկում էին դատավորին դիմել Սահմանադրական դատարան և վիճարկել հենց վերջին հոդվածի սահմանադրականությունը։ Դատարանում նաև ելույթ է ունեցել Ավետիք Չալաբյանը՝ նշելով, որ այս նորն ընդունվել է միայն մեկ նպատակով՝ իր դեմ գործ սկսելու համար։
«Այս նորմով երբևիցե Հայաստանում քրեական հետապնդում չի իրականացվել, սա առաջին դեպքն է, հորդորում եմ արձագանքել փաստաբաններիս միջնորդությանը և դիմել Սահմանադրական դատարան»,- ասել էր Չալաբյանը։
Նիստը նախագահող Մնացական Մարտիրոսյանը մերժել էր նաև այս միջնորդությունը, ինչպես և ցանկացած այլ ողջամիտ միջնորդություն, որ ներկայացնում են Չալաբյանի փաստաբանները։ Մնացական Մարտիրոսյանը հայտարարել է, թե նորմի սահմանադրականության հետ կապված հիմնավոր կասկած չկա, ինչի հիմքով էլ միջնորդությունը մերժվում է։
Զարմանալի կլիներ, եթե տխրահռչակ դատավորը որևէ խնդիր տեսներ, եթե նրան նույնիսկ առաջարկեին Ավետիք Չալաբյանին դատապարտել Զիմբաբվեի քրեական օրենսգրքի որևէ հոդվածով, նա պատրաստ էր անել այդ քստմնելի արարքը, միայն թե կատարի գործող իշխանությունների կամքը և «ԱՐԱՐ» հիմնադրամի համահիմնադրին շարունակի պահել կալանքի տակ։
Չալաբյանի փաստաբանների միջնորդությունը մերժելուց հետո Մնացական Մարտիրոսյանը ավարտել է դատական նիստը, իսկ հաջորդը նշանակել օգոստոսի 10-ի կեսօրին։ Զարմացնում է նաև մեկ այլ հանգամանք. գործող իշխանությունները հնարավորինս արագ և շուտափույթ են դատական նիստերի օրերը նշանակում՝ ըստ երևույթին ցանկանալով առավելագույնս շուտ ավարտել դատաքննությունը և Ավետիք Չալաբյանի նկատմամբ մեղադրական վճիռ կայացնել։
Սովորաբար քրեական նման գործերով նիստերը տեղի են ունենում շաբաթը մեկ, մինչդեռ Ավետիք Չալաբյանի դեպքում շաբաթական առնվազն 3-4 դատական նիստ է տեղի ունենում, ինչը հիմք է տալիս հենց այսպիսի եզրակացություն անել դատավորի վարքից։
