Մարդու իրավունքների պաշտպանը դիմել է ՍԴ

ՀՀ մարդու իրավունքների պաշտպան Քրիստիննե Գրիգորյանն այսօր դիմել է Սահմանադրական դատարան՝ վիճարկելով հանրային ծառայության առանձին տեսակների համար սահմանված՝ արհեստակցական միություններին և կրոնական կազմակերպություններին անդամակցության արգելքի սահմանադրականությունը։
Այս մասին հայտնում են ՄԻՊ գրասենյակից։
Խոսքը վերաբերում է «Ոստիկանությունում ծառայության մասին» օրենքի 39-րդ հոդվածի 1-ին մասի 7-րդ կետին, «Արհեստակցական միությունների մասին» օրենքի 6-րդ հոդվածի 5-րդ մասին, «Ազգային անվտանգության մարմիններում ծառայության մասին» օրենքի 43-րդ 1-ին մասի 8-րդ, «Զինվորական ծառայության և զինծառայողի կարգավիճակի մասին» օրենքի 8-րդ հոդվածի 1-ին մասի 3-րդ կետերին, որոնցով ՀՀ ոստիկանության, ազգային անվտանգության մարմիններում ծառայողների, զինծառայողների, դատախազների, դատավորների և Սահմանադրական դատարանի դատավորների համար նախատեսվում է արհեստակցական միություններին անդամակցելու, ազգային անվտանգության մարմիններում ծառայողների համար նաև՝ կրոնական կազմակերպություններին անդամակցելու, իսկ զինծառայողների համար՝ կրոնական միավորում ստեղծելու բացարձակ արգելք։
Դիմումով, մասնավորապես, նշվում է, որ արհեստակցական միություններին անդամակցելու արգելքը չի բխում նշված ծառայության տեսակների բնույթից և զրկում է աշխատողներին իրենց իրավունքների կոլեկտիվ պաշտպանության կարևորագույն միջոցից՝ հակադրվելով միավորումների ազատության բուն էությանը։ Նմանապես, Պաշտպանը վիճարկել է, որ ազգային անվտանգության մարմիններում ծառայությունը և զինվորական ծառայությունն ինքնին անհամատեղելի չեն կրոնական կազմակերպությանն անդամակցելու կամ այն ստեղծելու իրավունքի հետ։
Հարկ է նկատել, որ Սահմանադրական դատարանը դեռևս 2020 թվականի փետրվարի 18-ի ՍԴՈ-1506 որոշմամբ «Ոստիկանությունում ծառայության մասին» օրենքի 39-րդ հոդվածի 1-ին մասի 7-րդ կետը ոստիկանության ծառայողի համար կրոնական կազմակերպությանն անդամակցելու արգելք սահմանելու մասով ճանաչել է Սահմանադրությանը հակասող և անվավեր:
Հիմնելով վերոնշյալ որոշման, ինչպես նաև միջազգային իրավական փաստաթղթերի դրույթների և միջազգային ատյանների արտահայտած դիրքորոշումների վերլուծության վրա՝ դիմումով արձանագրվել է, որ վկայակոչված նորմերի նախատեսումը հանգեցրել է վերոնշյալ անձանց կրոնի ազատության և միավորումների ազատության անհամաչափ սահմանափակման։ Դիմումով Պաշտպանը վիճարկում է վկայակոչված նորմերի համապատասխանությունը ՀՀ Սահմանադրության 41-րդ, 45-րդ, 78-րդ, 79-րդ հոդվածներին։
