25.08.2022թ. Երևան քաղաքի դատախազությունում ստացվել և ուսումնասիրվել է սույն թվականի օգոստոսի 14-ին` ժամը 13:30-ի սահմաններում, Երևան քաղաքի Արշակունյաց պողոտայի 15-րդ հասցեում գտնվող «Սուրմալու» առևտրի կենտրոնում տեղի ունեցած պայթունի դեպքով նախաձեռնված և ՀՀ քննչական կոմիտեի Երևան քաղաքի քննչական վարչության ծանր հանցագործությունների քննության բաժնում քննվող քրեական վարույթի նյութերը: Ուսումնասիրության արդյունքում քրեական վարութի նյութերում առկա, անձանց կողմից հանցանքի կատարման մասին վկայող փաստերի հիման վրա 25.08.2022թ. քրեական վարույթի օրինականության նկատմամբ հսկողություն իրականացնող դատախազը իր նախաձեռնությամբ որոշում է կայացրել երկու անձի նկատմամբ ՀՀ քրեական օրենսգրքի 357-րդ հոդվածի 2-րդ մասով( Հոդված 357.Հրդեհային անվտանգության կանոնները կամ պահանջները խախտելը, որն անզգուշությամբ առաջացրել է մարդու մահ կամ այլ ծանր հետևանք` ) հանրային քրեական հետապնդում հարուցելու մասին: Որոշումներն ուղարկվել են քննիչին և հանձնարարություն է տրվել օրենքով սահմնանված ժամկետում նշված անձանց մեղադրանք ներկայացնել և կալանավորումը որպես խափանման միջոց ընտրելու միջնորդություն ներկայացնել դատարան: Բացի այդ, քրեական վարույթի նյութերի ուսումնասիրությամբ պարզվել է նաև, որ առկա փաստերը վկայում են ևս երկու անձի նկատմամբ ՀՀ քրեական օրենսգրքի 165-րդ հոդվածի 2-րդ մասով (Հոդված 165. Անզգուշությամբ երկու կամ ավելի անձանց կյանքից զրկելը)հանրային քրեական հետապնդում հարուցելու բավարար հիմքերի առկայության մասին, ուստի քննիչին հանձնարարվել է քրեական վարույթ նախաձեռնել նաև ՀՀ քրեական օրենսգրքի 165-րդ հոդվածով և ձեռնմուխ լինել դրանում մեղավոր անձանց քրեական հետապնդում հարուցելուն ուղղված վարույթային գործողություններ կատարելուն:Նույն օրը քննիչի կողմից ՀՀ քրեական օրենսգրքի 165-րդ հոդվածի 2-րդ մասով նախաձեռնվել է քրեական վարույթ և նշված անձանց նկատմամբ հանրային քրեական հետապնդում հարուցելու միջնորդություններ են ներկայացվել դատախազին, որոնք բավարարվել են:
Արդեն 26.08.2022թ. չորս անձ ձերբակալվել է՝ երկուսը ՀՀ քրեական օրենսգրքի 357-րդ հոդվածի 2-րդ մասով, երկուսը՝ 165-րդ հոդվածի 2-րդ մասով: Քրեական վարույթի նախաքննության մանրամասների վերաբերյալ կտրվի լրացուցիչ տեղեկատվություն:
Ծանուցում. ենթադրյալ հանցանքի մեջ կասկածվողը կամ մեղադրվողը համարվում է անմեղ, քանի դեռ նրա մեղավորությունն ապացուցված չէ ՀՀ քրեական դատավարության օրենսգրքով սահմանված կարգով` դատարանի` օրինական ուժի մեջ մտած դատավճռով:
