Աուդիտորական կազմակերպության ընտրությանը ներկայացվող պահանջները լիազորել համայնքի ավագանուն. «Փաստ»

«Փաստ» օրաթերթը գրում է
Տարածքային կառավարման և ենթակառուցվածքների նախարարությունը հանրային քննարկման է ներկայացրել «Տեղական ինքնակառավարման մասին» օրենքում լրացումներ կատարելու մասին և «Երևան քաղաքում տեղական ինքնակառավարման մասին» օրենքում փոփոխություն և լրացում կատարելու մասին օրենքների նախագծերը: Նախագծերի հեղինակները նշում են, որ «Երևան քաղաքում տեղական ինքնակառավարման մասին» Հայաստանի Հանրապետության օրենքի համաձայն ավագանին պարտավոր է ներգրավել աուդիտորական ծառայություններ, սակայն օրենքով հստակ չեն այդ ծառայությունների ներգրավվման կարգը և դրան ներկայացվող պահանջները, ինչը ստեղծում է հավել յալ դժվարություններ աուդիտորական ծառայությունների ձեռք բերման պրոցեսում։
Առկա չեն աուդիտորական ծառայությունների ներգրավման և անցկացման մասով պահանջներ, որը թույլ կտա սահմանելով որոշակի պահանջներ՝ ներգրավել որակյալ աուդիտորական ծառայություններ՝ նոր մակարդակի բարձրացնելով Երևանի բյուջեի կատարման տարեկան հաշվետվությունների աուդիտի ենթարկելու գործընթացը, իսկ «Տեղական ինքնակառավարման մասին» օրենքով վերջինս կարգավորված չէ: Միևնույն ժամանակ, օրենքով չի ամրագրվում, թե ում կողմից է սահմանվում աուդիտորական ծառայությունների ներգրավման կարգը և դրան ներկայացվող պահանջները, որից ելնելով ծագել է անհրաժեշտություն համապատասխան փոփոխություն կատարել օրենքում՝ լիազորությունները պատվիրակելով Երևան քաղաքի ավագանուն, ինչպես նաև համապատասխան կարգավորումներն իրականացնել նաև մյուս համայնքներում՝ պայմանավորված համայնքների խոշորացմամբ՝ բացառությամբ մեծամասնական ընտրակարգով ձևավորվող ավագանի ունեցող համայնքների:
Սույն նախագծերով առաջարկվում է համայնքի ավագանուն լիազորել սահմանելու աուդիտորական կազմակերպության ընտրությանը ներկայացվող պահանջները, ինչպես նաև բյուջեի կատարման տարեկան հաշվետվության ստուգման արդյունքներով կազմված եզրակացության մեջ Հայաստանի Հանրապետության օրենսդրությանը և համայնքի գործունեությանն առնչվող այլ պայմաններին (պայմանագրերին և այլնին) անհամապատասխանությունների մասին տեղեկություններ հայտնաբերելու դեպքում համապատասխան իրավասու մարմինների դիմելու լիազորություն։ Նախագծերի ընդունման դեպքում օրենքներում հստակ ամրագրված կլինի, որ աուդիտորական ծառայությունների ներգրավմանը և դրանց ներկայացվող պահանջներին վերաբերող հարաբերությունները կանոնակարգվում են համայնքի ավագանու որոշմամբ։
