Որ «Մացոները» արդարադատություն չիրականացնեն. փոխել Չալաբյանի գործով դատավորին

Երևանի ընդհանուր իրավասության դատարանում շուրջ մեկ ամիս է չի ընթանում «ԱՐԱՐ» հիմնադրամի համահիմնադիր, հասարակական-քաղաքական գործիչ Ավետիք Չալաբյանի գործով դատաքննությունը։ Միակ դատական նիստը եղել է վերաքննիչ քրեական դատարանում, որտեղ դատավոր Ռուզաննա Բարսեղյանը որոշում կայացրեց Չալաբյանին ազատ արձակել կալանքից։
Ամենայն հավանականությամբ առաջիկայում կվերսկսվի դատաքննությունը Մնացական Մարտիրոսյանի նախագահությամբ։ Չի բացառվում, որ այս անգամ ևս դատարանը կփորձի մի պատրվակ գտնել Չալաբյանին կրկին կալանավորելու համար։ Թեև նշենք՝ Չալաբյանի կալանավորմամբ շահագրգռված են միայն Մնացական Մարտիրոսյանն ու երկրի վարչապետի աթոռը զավթած Նիկոլ Փաշինյանը։ Նույնիսկ դատախազությունը, որը պաշտպանում է մեղադրանքը, դեմ չէր Ավետիք Չալաբյանին գրավով ազատ արձակելուն։
Մինչ այդ Մնացական Մարտիրոսյանի վերաբերյալ գործ է քննվում Բարձրագույն դատական խորհրդում։ Արդարադատության նախարար Կարեն Անդրեասյանն է կարգապահական վարույթ հարուցել նրա դեմ։ Բանն այն է, որ ժամանակին Մնացական Մարտիրոսյանը դատապարտել էր ԲԴԽ նախագահի նախկին ժամանակավոր պաշտոնակատար Գագիկ Ջհանգիրյանի եղբորը՝ Վարդան Ջհանգիրյանին։
Առողջական խնդիրներ ունեցող Վարդան Ջհանգիրյանը կալանքի տակ մնաց 3 ամիս, իսկ հետո Մնացական Մարտիրոսյանը նրան դատապարտել էր 3 տարվա պայմանական ազատազրկման, արգելեց բուժման նպատակով լքել հանրապետությունը։
ՄԻԵԴ որոշմամբ արձանագրվել էին կոնվենցիայի լրջագույն խախտումներ, և պետությունը պետք է Ջհանգիրյանին փոխհատուցի 22 հազար եվրո՝ վճռի և դատական այլ ծախսերի համար։ Այժմ նախարարը կարգապահական վարույթ է հարուցել, ինչը պարզապես օրենքի պահանջն է և չի բացառվում, որ Բարձրագույն դատական խորհուրդը մերժի Մնացական Մարտիրոսյանի դեմ հարուցված կարգապահական վարույթը, և «տխրահռչակ Մացոն» շարունակի նույն ձև դատել օրվա իշխանությունների քաղաքական հակառակորդներին։
Ինչպես նախկին իշխանությունների օրոք դատում էր նրանց քաղաքական ընդդիմախոսներին, այդ թվում նաև Նիկոլ Փաշինյանին, այնպես էլ այժմ դատում է Նիկոլ Փաշինյանի քաղաքական ընդդիմախոսներին։ Եվ եթե նրան չհեռացնեն դատավորի պաշտոնից, մի օր էլ Մնացական Մարտիրոսյանը նույն ավյունով կվարի գործող ռեժիմի ներկայացուցիչների դատական նիստերը։
