Նախատեսվում է Երևանում ձևավորել երկու նոր՝ քրեական և քաղաքացիական դատարաններ

Արդարադատության նախարարության կողմից մշակվել է «Հայաստանի Հանրապետության դատական օրենսգիրք» սահմանադրական օրենքում փոփոխություններ և լրացումներ կատարելու մասին» սահմանադրական օրենքի նախագիծը, որով նախատեսվում է Երևան քաղաքի առաջին ատյանի ընդհանուր իրավասության դատարանի փոխարեն ձևավորել երկու նոր դատարաններ՝ Երևան քաղաքի քրեական և քաղաքացիական դատարանները: Այս մասին հայտնում է ՀՀ արդարադատության նախարարությունը։

«Նախագծի մշակման անհրաժեշտությունը պայմանավորված է եղել առաջին հերթին Երևան քաղաքի առաջին ատյանի ընդհանուր իրավասության դատարանի գերծանրաբեռնվածությամբ, ինչն էականորեն խոչընդոտում է այս դատարանում աշխատանքների արդյունավետ կազմակերպումը:

Երևան քաղաքի ընդհանուր իրավասության դատարանը, լինելով Հայաստանի Հանրապետությունում ընդհանուր իրավասության դատարաններից մեկը, Դատական օրենսգրքի համաձայն՝ պետք է գործի առնվազն 62 դատավոր թվակազմով, որում առանձնացված են քաղաքացիական և քրեական մասնագիտացման դատավորները: Այս պահի դրությամբ Երևան քաղաքի առաջին ատյանի ընդհանուր իրավասության դատարանում պաշտոնավարում են թվով 72 դատավորներ, որոնցից՝ քրեական մասնագիտացմամբ՝ 33-ը, իսկ քաղաքացիական մասնագիտացմամբ՝ 39-ը:

Ներկայացվածից ակնհայտ է Երևան քաղաքի առաջին ատյանի ընդհանուր իրավասության դատարանի գերծանրաբեռնվածությունը՝ մյուս դատարանների համեմատությամբ:

Թե՛ կադրային և թե՛ քննվող գործերի ծանրաբեռնվածության պայմաններում գրեթե դժվարանում, իսկ երբեմն նաև անհնար է դառնում դատարանի բնականոն գործունեության կազմակերպումն ու ապահովումը, ինչն էլ իր ազդեցությունն է թողնում անձանց դատական պաշտպանության իրավունքի պատշաճ իրացման ապահովման վրա:

Մյուս կողմից, Նախագծով նախատեսվում է դատարանի նախագահին գործերի քննության ժամկետների պահպանմանը հետևելու լիազորություն վերապահել, ինչի համատեքստում ևս Երևան քաղաքի առաջին ատյանի ընդհանուր իրավասության դատարանում դատավորների թվակազմը և քննվող գործերի մեծ ծավալը խոչընդոտելու են այդ լիազորության արդյունավետ իրականացմանը՝ հաշվի առնելով նաև դատավորների ու նախագահի մասնագիտացվածության տարբերությունը:

Վերոնշվածի համատեքստում հարկ է կարևորել, որ դատարանների մասնագիտացումը սովորաբար դիտվում է որպես բարեփոխումների կարևոր նախաձեռնություն, որն ուղղված է հաջող դատական համակարգի զարգացմանը»,- նշված է հաղորդագրությունում։
