Պետությանը պատճառվել է 350 միլիոն դրամի գույքային վնաս

Գլխավոր դատախազության պետական շահերի պաշտպանության վարչությունում Պետական գույքի կառավարման կոմիտեից ստացված փաստաթղթերի ուսումնասիրությամբ պարզվել է, որ «Գույքի գնահատման և աճուրդի կենտրոն» ՊՈԱԿ-ը 2021թ.-ին իրականացրել է Երևանի Դավիթ Բեկի փ. 155/1 հասցեում գտնվող պետական սեփականություն հանդիսացող 2159 քմ մակերեսով շինությունների և 4498 քմ մակերեսով հողամասի գնահատում, որի արժեքը, 15.01.2021թ. գնահատման հաշվետվությամբ, կազմել է 234 մլն 703 հազար դրամ:Այս մասին տեղեկացնում է ՀՀ դատախազության հանրային կապերի բաժինը:
Կառավարության համապատասխան որոշմամբ, այն 175 մլն 104 հազար դրամով օտարվել է քաղաքացի Լ. Խ.-ին:
Մինչդեռ, Կադաստրի կոմիտեի «e-cadastre.am» կայքում առկա տվյալների համաձայն, նշված անշարժ գույքի շուկայական արժեքին մոտարկված կադաստրային արժեքը կազմում է շուրջ 527 մլն 616 հազար դրամ, այսինքն՝ շուրջ 2 անգամ ավել գնահատման և շուրջ 3 անգամ ավել վաճառքի արժեքից:
Ուսումնասիրությամբ պարզվել է, որ արձանագրված փաստերը վկայում են, որ ՊՈԱԿ-ի գնահատողի կողմից կազմված և նույն ՊՈԱԿ-ի գլխավոր տնօրենի կողմից հաստատված գնահատման հաշվետվությամբ՝ 527 մլն 616 հազար դրամ արժեքով վերոնշյալ հասցեում գտնվող պետական սեփականություն հանդիսացող 2159 քմ մակերեսով շինությունները և 4498 քմ մակերեսով հողամասը գնահատվել են 234 մլն 703 հազար դրամ, որն էլ հիմք է ընդունվել նշված անշարժ գույքի օտարման համար: Արդյունքում, նշված գույքն օտարվել է 175 մլն 104 հազար դրամով կամ շուրջ 3 անգամ պակաս շուկայական արժեքին մոտարկված կադաստրային արժեքից՝ պետությանը պատճառելով շուրջ 350 մլն դրամի առանձնապես խոշոր չափերի գույքային վնաս՝ առաջացնելով ծանր հետևանքներ:
Նկատի ունենալով, որ ուսումնասիրությամբ առկա են եղել պաշտոնատար անձի կողմից իր պաշտոնեական դիրքը ծառայության շահերին հակառակ օգտագործելու կամ ծառայողական պարտականությունները չկատարելու՝ շահադիտական, անձնական այլ շահագրգռվածությունից կամ խմբային շահերից ելնելով, ծանր հետևանքներ առաջացնելու, ինչպես նաև՝ 314-րդ հոդվածի 1-ին մասով նախատեսված հանցագործության՝ պաշտոնեական կեղծիք կատարելու հատկանիշներ, Պետական շահերի պաշտպանության վարչության կողմից կատարված ուսումնասիրության արդյունքներն ուղարկվել են Հակակոռուպցիոն կոմիտե՝ քրեական վարույթ նախաձեռնելու:
