Նախկին սենատոր Լևոն Չախմախչյանն ամբողջությամբ արդարացվեց

Մարդու իրավունքների եվրոպական դատարանն անօրինական է ճանաչել Կալմիկիայի նախկին սենատոր Լևոն Չախմախչյանի նկատմամբ քրեական հետապնդումն ու դատապարտումը։ Այս մասին տեղեկացնում է dzen.ru կայքը:
Մարդու իրավունքների եվրոպական դատարանը 2022 թ. հոկտեմբերի 4-ի որոշմամբ Կալմիկիայի նախկին սենատոր Լևոն Չախմախչյանի գործով արձանագրել է Կոնվենցիայի 6-րդ հոդվածի 1-ին կետի և Մարդու իրավունքների կոնվենցիայի 8-րդ հոդվածի խախտում։ Դատավորները որոշել են նաև, որ դիմողին պետք է վճարվի բարոյական վնասի փոխհատուցում 8000 եվրոյի չափով։ Հիշեցնենք, որ Չախմախչյանի դեմ շատ տարօրինակ հանգամանքներում քրեական գործ էր հարուցվել 2006 թ., երբ նա Դաշնային խորհրդում ներկայացնում էր Կալմիկիայի շահերը և միաժամանակ ղեկավարում Ռուս-հայկական գործարար համագործակցության ասոցիացիան (ԱՐԱԴԵՍ)։
Չնայած ակնհայտ կեղծված ապացույցներին և մի շարք ընթացակարգային խախտումներին, 2008 թ. հուլիսին Մոսկվայի քաղաքային դատարանը սենատորին դատապարտեց Ռուսաստանի Դաշնության Քրեական օրենսգրքի 159-րդ հոդվածի 4-րդ մասով նախատեսված հանցագործություն կատարելու («խարդախության փորձ») մեջ՝ սահմանելով ինը տարվա ազատազրկում: Գերագույն դատարանի վճռաբեկ խորհուրդը ժամկետը կրճատեց մինչև յոթ ու կես տարի։ Նույն գործի շրջանակներում նրա քրեական գործով ներգրավված այլ մեղադրյալներ ևս դատապարտվել են։ Ի դեպ, Չախմախչյանի փեսան՝ ՌԴ Հաշվիչ պալատի նախկին գլխավոր մասնագետ Արմեն Հովհաննիսյանը, նույնպես անմեղ է ճանաչվել, նա նույնպես փոխհատուցման իրավունք է ստացել։ ՄԻԵԴ-ի վճիռը ոչ միայն վերջ է դնում այս պատմությանը, այլև վերականգնում է արդարությունն անմեղ դատապարտվածների նկատմամբ։ «Եթե Ռուսաստանը դուրս չգար Եվրոպական դատարանի իրավասությունից, Չախմախչյանի նկատմամբ պատիժը կվերացվեր»,- ասում է Չախմախչյանի փաստաբան Աննա Ստավիցկայան։ Մինչդեռ գործը կարող էր չհասնել Եվրոպական դատարան։ Անարդար դատավճռից հետո Չախմախչյանի գործի «հետաքննության» շատ առանցքային դեմքեր՝ դատավարության պետական դատախազ Սերգեյ Դուբինսկին, ԱԴԾ սպա Դմիտրի Ֆրոլովը և այլք, հայտնվեցին ճաղերի հետևում՝ կաշառակերության մեղադրանքով, իսկ պատվերը կատարողները՝ «Տրանսաերո»-ի սեփականատերեր Ալեքսանդր և Օլգա Պլեշակովները, ներկայումս փախուստի մեջ են։ Ամբողջական և վերջնական արդարության հաստատման համար անհրաժեշտ է, որ նրանց դեմ բացված քրեական գործերը վերաքննվեն, և մարդկանց վերադարձվի իրենց բարի անունը։
