«Փաստ» օրաթերթը գրում է
Այսպես կոչված, հնարավոր «խաղաղության պայմանագիրը» ներկա փուլում ամենաքննարկվող թեմաներից մեկն է, եթե ոչ ամենաքննարկվողը: Այս կոնտեքստում նշվում է, որ իշխանությունները փաստացի ձեռքները լվանում են Արցախից, ինչը սկզբունքորեն չեն թաքցնում նաև Նիկոլ Փաշինյանն ու իր թիմը: Ավելին, վերջիններս անընդհատ շեշտում են, թե Արցախն Ադրբեջանի կազմում ճանաչել են դեռևս նախկին իշխանությունները՝ ստորագրելով Ալա-Աթայի հռչակագիրը և մտնելով ԱՊՀ կազմ (խոսքն այն մասին է, որ այդպիսով ճանաչվել է Ադրբեջանի տարածքային ամբողջականությունը)։ Այն, որ նման «փաստարկն» իրավական տեսանկյունից բացարձակ սնանկ ու հիմնազուրկ է, ոչ մեկ անգամ նշել են բազմաթիվ մասնագետներ:
Ավելին, ՀՀ իշխանությունների կողմից որևէ փաստաթղթի ստորագրում, որը Արցախը կհանձնի Ադրբեջանին, ուղղակի կհակասի ՀՀ անկախության հռչակագրին, որտեղ հստակ ամրագրված է, որ ՀՀ-ն ճանաչում է Արցախի ինքնորոշման իրավունքը, ինչը վավերացվել է 1990 թվականին Գերագույն խորհրդի կողմից։ Բանն այն է, որ անկախության հռչակագիրը պետության հիմնադիր փաստաթուղթն է և հիմք է հանդիսանում ՀՀ Սահմանադրության համար, ավելին, պատահական չէ, որ ՀՀ Սահմանադրությունը սկսվում է հենց Անկախության հռչակագիրը վկայակոչելով։ «Փաստ» թերթի տեղեկություններով, իրականում իշխանությունները ևս հիանալի հասկանում են այս ամենը։
Ըստ այդմ, մեր աղբյուրների փոխանցմամբ, Նիկոլ Փաշինյանի կողմից ներկայումս ստեղծվել է մի, այսպես կոչված, «աշխատանքային խումբ», որը աշխատում է «խաղաղության պայմանագիր» կոչվածի իրավական հատվածի վրա՝ փորձելով տարբեր սահմանադրական «լազեյկաներ» գտնել՝ այն հարմարեցնելով իրենց քաղաքական քիմքին, ու հավանական փաստաթղթի ստորագրման համար իրավական «հիմքեր» ստեղծել։ Մեր տեղեկություններով, այդ «հանձնաժողովում» ընդգրկված են Փաշինյանի իշխանությանը սպասարկող մի շարք իրավաբաններ, որոնք արդեն լծվել են գործի։
Ի դեպ, թերթի հետ զրույցում մի քանի հայտնի իրավաբաններ և սահմանադրագետներ նշել են, որ նշյալ թեմայով Փաշինյանի և նրա թիմի կողմից տիրաժավորվող թեզերը հակասահմանադրական են և իրավական ոչ մի ուժ չեն կարող ունենալ։
