Հայաստանի սահմանը հատած Թուրքիայի քաղաքացին դատապարտվել է 9 ամիս ազատազրկման

Հայաստանի Հանրապետության պետական սահմանն ապօրինի հատած Թուրքիայի քաղաքացին դատապարտվել է 9 ամիս ազատազրկման։ Այս մասին տեղեկանում ենք Դատական «DataLex» տեղեկատվական համակարգից։
Թուրքիայի քաղաքացի Աթայ Բիլալը 2022 թվականի հունվարի 8-ին՝ ժամը 18:54-ի սահմաններում, շրջանցելով ՀՀ սահմանային անցակետերը, հետիոտն անցնելով հայ-թուրքական սահմանով հոսող Արաքս գետը և ՀՀ-ում ՌԴ անվտանգության դաշնային ծառայության սահմանապահ զորքերի սահմանապահ ուղեկալի կողմից հսկվող տարածքում հաղթահարելով ինժեներատեխնիկական պատնեշը, ապօրինի՝ առանց սահմանված փաստաթղթերի և պատշաճ թույլտվության, հատել է ՀՀ պահպանվող պետական սահմանը և Թուրքիայի կողմից մուտք է գործել Հայաստան, որտեղ բռնվել է ՀՀ-ում ՌԴ անվտանգության դաշնային ծառայության սահմանապահների կողմից։
Նրան մեղադրանք է ներկայացվել նախկին ՔՕ–ի 329–րդ հոդվածի 1–ի մասի հատկանիշներով, որը նախատեսում էր պատիժ տուգանքով՝ նվազագույն աշխատավարձի հարյուրապատիկից երկուհարյուրապատիկի չափով, կամ ազատազրկմամբ՝ առավելագույնը երեք տարի ժամկետով:
Արարատի և Վայոց Ձորի մարզի ընդհանուր իրավասության դատարանի դատավոր Գառնիկ Ստեփանյանի վճռով Բիլայի պատժի կրման սկիզբը հաշվվելու է 2022 թվականի հունվարի 8-ից: Դատավճռում նշվում է, որ այն կարող է բողոքարկվել մեկ ամսում` ՀՀ վերաքննիչ քրեական դատարան: «Դատավճիռը չի կարող բողոքարկվել ՀՀ քրեական դատավարության օրենսգրքի 395-րդ հոդվածի 1-ին մասի 1-ին և 4-րդ կետերով նախատեսված հիմքերով»: Դատական ակտն ընդունվել է սեպտեմբերի 12-ին։
