Արդարադատության նախարարությունն առաջարկում է ռազմական դրության ժամանակ ավելի խիստ սահմանափակումներ ներառել օրենքում։ ԱՆ-ն ներկայացրել է «Ռազմական դրության իրավական ռեժիմի մասին» օրենքում փոփոխությունների նախագիծ , որը վերաբերում է ինտերնետ հասանելիության, էլեկտրոնային մամուլի, սոցիալական ցանցերի և հավելվածների մասնակի կամ ամբողջական սահմանափակմանը։

«Օրենքն ընդունվելու դեպքում Կառավարությունը կարող է արգելափակել սոցցանցերը, էլեկտրոնային մեդիան, հավելվածներ, այն ամենը, ինչ կապված է համացանցի հետ և կարող է համարվել սպառնալիք ռազմական դրության իրավական ռեժիմին»։

Ներկա օրենքով սահմանված է կարծիքի արտահայտման ազատության սահմանափակում, ինչպես նաև տպագրող սարքերի, ռադիոհեռարձակող, ձայնաուժեղացնող տեխնիկական միջոցների, բազմացնող տեխնիկայի ժամանակավոր առգրավում կամ կալանք, լրագրողների հավատարմագրման հատուկ կարգի, կապի միջոցներից օգտվելու հատուկ կանոնների սահմանում, սակայն համացանցի մասին խոսք չկար։

Նոր նախագծով նախատեսվում է ամրագրել հետևալը. «Հայաստանի Հանրապետության տարածքում ինտերնետային կայքերի, սոցիալական ցանցերի, ինտերնետային հավելվածների գործողության ժամանակավոր կասեցում (արգելափակում), ինչպես նաև ինտերնետ հասանելիության մասնակի կամ ամբողջական սահմանափակում։ Հայաստանի Հանրապետության տարածքում ինտերնետ հասանելիության սահմանափակման դեպքում պետական կառավարման համակարգի և տեղական ինքնակառավարման մարմինների, ռազմավարական նշանակության և պետական պահպանության ենթակա օբյեկտների և ենթակառուցվածքների, ինչպես նաև առանձին կազմակերպությունների (անկախ կազմակերպական-իրավական ձևից) ինտերնետ հասանելիության ապահովում»,- նշվում է նախագծում։

Ըստ առաջարկվող փոփոխության, ռազմական դրության պայմաններում կիրառվող ոչ ռազմական բնույթի միջոցառումների իրականացման և սահմանափակումների կիրառման լիազորությունը տրվելու է փոխվարչապետին, որը կարող է ընդունել ենթաօրենսդրական ակտեր։ Կառավարության որոշմամբ կարող է ստեղծվել ռազմական դրության տարածքի հատուկ կառավարման խորհուրդ՝ որպես Հայաստանի Հանրապետության վարչապետին կից խորհրդակցական մարմին: Խորհուրդը կղեկավարի վարչապետը:

Որպես հիմնավորում Արդարադատության նախարարութունն նշում է, որ ըստ էության ռազմական դրություն հայտարարելու նպատակն է Հայաստանի Հանրապետության զինված ուժերի և տնտեսության զորահավաքային ծավալման համար առավելագույն բարենպաստ պայմանների ստեղծմամբ դիմակայել Հայաստանի Հանրապետության վրա զինված հարձակմանը կամ կանխել դրա անմիջական վտանգը, ինչպես նաև ապահովել պետական և տեղական ինքնակառավարման մարմինների բնականոն գործունեությունն ու մարդկանց կյանքի և անվտանգության պաշտպանությունը ռազմական դրության պայմաններում։
