«Փաստ» օրաթերթը գրում է
ՏԿԵՆ-ի առաջարկած նախագծով փոփոխություններ և լրացումներ կկատարվեն մի շարք օրենքներում: Դրանց արդյունքում «Երևան քաղաքում տեղական ինքնակառավարման մասին», «Տեղական ինքնակառավարման մասին» և «Պաշտպանության մասին» օրենքներում հստակ կամրագրվի, որ համայնքի ղեկավարը վարելու է համայնքում հաշվառված զինապարտների վերաբերյալ գրանցամատյան: Միևնույն ժամանակ, նկատի ունենալով այն հանգամանքը, որ հիշյալ տեղեկատվությունը ստանալու հավաքագրման աղբյուր առկա չէ, նախագծով առաջարկվում է նախատեսել, որ համայնքի ղեկավարը գրանցամատյանը վարելու է պետական լիազոր մարմնի կողմից ներկայացված տեղեկատվության հիման վրա:
«Երևան քաղաքում տեղական ինքնակառավարման մասին» օրենքի 68-րդ հոդվածի 1-ին մասի 1-ին կետով նախատեսված է, որ Երևանում պաշտպանության կազմակերպման բնագավառում քաղաքապետն իրականացնում է հետևյալ լիազորությունները՝ օրենքով սահմանված կարգով վարում է համայնքի զինապարտների գրանցամատյան, նրանց վերաբերյալ ցուցակները, ինչպես նաև ըստ բնակության վայրի հաշվառումից հանվելու, աշխատանքի ընդունվելու և աշխատանքից ազատվելու վերաբերյալ տվյալները ներկայացնում է տարածքային զինվորական կոմիսարիատ: «Տեղական ինքնակառավարման մասին» օրենքի 40-րդ հոդվածի 1-ին մասի 1-ին կետով նախատեսված են համայնքի ղեկավարի նմանատիպ լիազորությունները:
«Պաշտպանության մասին» օրենքի 21-րդ հոդվածի 5-րդ մասում ամրագրված կարգավորման համաձայն՝ զինապարտների զինվորական հաշվառման լրիվությունն ապահովելու նպատակով պետական և տեղական ինքնակառավարման մարմինները, անկախ կազմակերպական-իրավական ձևից` գործատու կազմակերպություններն ու ուսհաստատությունները վարում են աշխատող կամ սովորող, իսկ ՏԻՄերը` նաև համայնքում բնակվող զինապարտների վերաբերյալ գրանցամատյան, որի վարման կարգը սահմանում է կառավարությունը:
Բոլոր վերը նշված օրենքներում առկա են հակասություններ, օրինակ` ՏԻՄ-երը համայնքում բնակվող, նաև հաշվառված զինապարտների վերաբերյալ գրանցամատյանը վարելու համար անհրաժեշտ տվյալների հավաքագրման աղբյուր չունեն և տեղեկատվությունը ներկայացնելու փոխարեն այն ստանում են ՀՀ ՊՆ Զ և ԶՀԾ տարածքային ստորաբաժանումներից, և այսպես շարունակ: Հենց այս և մի շարք այլ հակասությունները վերացնելու նպատակով ՏԿԵՆ-ն առաջարկում է փոփոխություններ կատարել մի շարք օրենքներում:
