Արագածոտնի մարզի Ապարան համայնքի Եղիպատրուշ գյուղի բնակիչներից մեկը մասնավորապես նշել է, որ հանրության գերակա շահ ճանաչված տարածքում սեփականության իրավունքով իրեն պատկանող հողամասի (Արագածոտնի մարզ, Ապարան համայնք, Եղիպատրուշ գյուղ, 0,3799 հա) համար առաջարկվող փոխհատուցման գումարն օբյեկտիվորեն չի համապատասխանում իր անշարժ գույքի շուկայական արժեքին:
 
Մինչդեռ Հայաստանի Հանրապետության հողային օրենսգրքի 104-րդ հոդվածի 1-ին մասի համաձայն՝ հանրության գերակա շահերի ապահովման նպատակով հողամասի սեփականության օտարումն իրականացվում է օրենքով սահմանված բացառիկ դեպքերում և կարգով` միայն նախնական և համարժեք փոխհատուցմամբ: Մասնավորապես «Հանրության գերակա շահերի ապահովման նպատակով սեփականության օտարման մասին» ՀՀ օրենքի 11-րդ հոդվածի 1-ին մասի համաձայն՝ oտարվող սեփականության դիմաց սեփականատիրոջը վճարվում է համարժեք փոխհատուցում: Համարժեք է համարվում օտարվող գույքի շուկայական արժեքից տասնհինգ տոկոս ավելի գումարը:
 
Տվյալ դեպքում փորձագիտական կազմակերպությունը տվել է գնահատման եզրակացություն և որոշել, որ հողամասի փոխհատուցումը կազմել է 544 525 ՀՀ դրամ, որը հաշվարկվել է 1 քմ հողամասի համար 133 ՀՀ դրամ արժեքով: Որոշումն առաջացրել է քաղաքացու դժգոհությունը:
 
Այս կապակցությամբ գրություն եմ ուղարկել ՀՀ Էկոնոմիկայի նախարարին, ով վստահեցրել է, որ հանրության գերակա շահ ճանաչված տարածքների օտարման գործընթացն իրականացվում է ՀՀ օրենսդրության դրույթներին համապատասխան։
 
Հարկ է նկատել, որ վերոնշյալի համատեքստում առնվազն մտորրումների տեղիք է տալիս ՀՀ Էկոնոմիկայի նախարարի վերոնշյալ ձևակերպումը, այն պարագայում, որ առկա են դատական գործեր, որով վիճարկվում են վերոնշյալ հանգամանքները: Ըստ այդմ՝ օտարման գործընթացն իրականացվում է ՀՀ օրենսդրության դրույթներին համապատասխան, թե ոչ, կորոշի դատարանը։
 
Ինչևէ, Եղիպատրուշ գյուղի բնակիչը և իր պնդմամբ, այլ համագյուղացիներ ևս, մնում են դժգոհ որոշումից, քանի որ այդպիսով իրենց խնդիրը լուծում չի ստանում:
 
Նշեմ, որ առկա է Թեղուտի պղնձամոլիբդենային հանքավայրի վերաբերյալ համանման պրակտիկա, երբ դժգոհ քաղաքացիները, ովքեր ընդդեմ Հայաստանի բողոքներ են ներկայացրել Մարդու իրավունքների եվրոպական դատարան, ըստ էության վերջինիս կողմից բողոքներից շատերը ընդունելի են համարվել և դատարանի կողմից առնվազն փաստվել է բողոքաբերների սեփականության իրավունքի խախտման հանգամանքը:
 
Պետական պաշտոնյաները պարտավոր են հարգել մարդու սեփականության իրավունքը և գործել դրա շրջանակներում:
