Հակակոռուպցիոն դատարանը 2023 թվականի հունվարի 24-ին վարույթ է ընդունել ապօրինի ծագում ունեցող գույքի բռնագանձման վերաբերյալ հերթական հայցադիմումը:

Գլխավոր դատախազության ապօրինի ծագում ունեցող գույքի բռնագանձման գործերով վարչությունը պահանջ է ներկայացրել դատարանին՝ Տավուշի մարզի նախկին մարզպետ Հ.Ա.-ից (Հովիկ Աբովյան) և վերջինիս փոխկապակցված անձանցից հօգուտ Հայաստանի Հանրապետության բռնագանձել.  

  • 11 անշարժ գույք, որոնցից հինգը՝ Երևան քաղաքում, վեցը՝ Տավուշի մարզում, իսկ անհնարինության դեպքում՝ դրանց միջին շուկայական արժեքները՝ 1 մլրդ 256 մլն 765 հազար դրամ, երեք շարժական գույք, երկու իրավաբանական անձանցում մասնակցության իրավունք.
  • Չեխական ընկերությունում գնված բաժնետոմսերի ձեռքբերման արժեքը՝ 1 մլն 608 հազար 540 դրամ.
  • 389 մլն 257 հազար 456 դրամ, որը չի հիմնավորվում անձի օրինական եկամուտներով, ունի ապօրինի ծագում և հնարավոր չէ բռնագանձել՝ հիմք ընդունելով «Ապօրինի ծագում ունեցող գույքի բռնագանձման մասին» ՀՀ օրենքի 20-րդ հոդվածի 4-րդ մասի իրավակարգավորումը (եթե ապօրինի ծագում ունեցող գույքը փոխանցվել է բարեխիղճ ձեռք բերողի, կամ այն անհնար է նույնականացնել, առանձնացնել կամ բռնագանձել, ապա դատարանի որոշմամբ, համապատասխան պահանջի առկայության դեպքում՝ պատասխանողից կարող է բռնագանձվել հայցի ներկայացման պահի դրությամբ ապօրինի ծագում ունեցող գույքի շուկայական արժեքի չափով գումար):
