ՀՀ քննչական կոմիտեի ԵՔՔՎ Մալաթիա-Սեբաստիա վարչական շրջանի քննչական բաժնում իրականացվում են քննչական և վարութային անհրաժեշտ գործողություններ՝ ոստիկանության ծառայողների օրինական ծառայողական գործունեությանը միջամտելու հերթական դեպքի հանգամանքները պարզելու ուղղությամբ:
2023 թվականի հունվարի 31-ին ՀՀ ոստիկանության Մալաթիայի բաժնից ՀՀ ՔԿ Երևան քաղաքի քննչական վարչության Մալաթիա-Սեբաստիա վարչական շրջանի քննչական բաժին հաղորդում է ստացվել այն մասին, որ 2023թ. հունվարի 30-ին՝ ժամը 23:30-ի սահմաններում, ՀՀ ոստիկանության «Պարեկային ծառայության» գնդի պարեկները, Երևան քաղաքի Օհանովի փողոցում ծառայություն իրականացնելիս, ստուգման նպատակով կանգնեցրել են «Օպել» մակնիշի ավտոմեքենա, ինչին միջամտել և խոչընդոտել են երկու քաղաքացիներ:

Պարեկների՝ իրենց գործողությունները, տրանսպորտային միջոցների ազատ տեղաշարժը չխոչընդոտելու և երթևեկելի ուղեգոտուց դուրս գալու խնդրանքին ի պատասխան՝ հիշյալ քաղաքացիները չեն ենթարկվել նրանց օրինական պահանջներին՝ շարունակելով իրենց գործողությունները:
Պարեկները նշված անձանցից մեկին փորձել են նստեցնել ծառայողական ավտոմեքենան, որի ընթացքում մոտեցել են այլ քաղաքացիներ, ովքեր սկսել են քաշքշել նրանց, ձեռքերով ու ոտքերով անկանոն հարվածներ հասցնել ոստիկաններից մեկի մարմնի տարբեր հատվածներին՝ պատճառելով մարմնական վնասվածքներ:

Դեպքի առթիվ ՀՀ քննչական կոմիտեի Երևան քաղաքի քննչական վարչության Մալաթիա-Սեբաստիա վարչական շրջանի քննչական բաժնում ՀՀ քրեական օրենսգրքի 452-րդ հոդվածի 3-րդ մասով, նախաձեռնվել է քրեական վարույթ:

Քննությամբ պարզվել է միջադեպին մասնակից անձանցից չորսի ինքնությունը, որոնցից մեկը ձերբակալվել է, իսկ միջադեպին մասնակից մյուս անձինք, օգտվելով ստեղծված իրավիճակից, դիմել են փախուստի:

Դեպքի ամբողջական հանգամանքները, ինչպես նաև մասնակից մյուս անձանց ինքնությունը, նրանցից յուրաքանչյուրի դերակատարումը պարզելու նպատակով պահանջվել են տեսախցիկների տեսագրությունները, ինչպես նաև Ոստիկանությանը տրվել է հանձնարարություն:
Հարուցված քրեական հետապնդման հիման վրա ձերբակալված անձին ներկայացվել է մեղադրանք` ՀՀ քրեական օրենսգրքի 452-րդ հոդվածի 3-րդ մասով։ Վերջինիս նկատմամբ դատարանի որոշմամբ որպես խափանման միջոց է ընտրվել տնային կալանքը։
Նախաքննությունը շարունակվում է։
Ծանուցում. հանցանքի համար մեղադրվողը համարվում է անմեղ, քանի դեռ նրա մեղավորությունն ապացուցված չէ ՀՀ քրեական դատավարության օրենսգրքով սահմանված կարգով` դատարանի` օրինական ուժի մեջ մտած դատավճռով:
