Հայաստանը չի կարողացել բավարար ապացույցներ ներկայացնել, որ Ադրբեջանն է ԼՂ-ում գազի ու հոսանքի դադարեցումների մեղավորը․ Նիկոլ Փաշինյանը՝ Հաագայի դատարանի որոշման մասին

Արդարադատության միջազգային դատարանն արձանագրեց, որ 2022 թ-ի դեկտեմբերի 12-ից Լաչինի միջանցքը փակ է, սա կարող է մեր հանրությանը տարօրինակ արձանագրում թվալ այն իմաստով, որ Լաչինի միջանցքի փակ լինելը ակնհայտ է բոլորիս համար։ Այս մասին կառավարության նիստում ասաց վարչապետ Նիկոլ Փաշինյանը՝ անդրադառնալով Հաագայի դատարանի որոշմանն ու դրա քաղաքական ազդեցությանը։
«Ադրբեջանը, սակայն, բոլոր միջազգային ատյաններում պնդում էր, որ Լաչինի միջանցքը փակ չէ։ Ինչքան էին միջազգային հանրության ներկայացուցիչները դրան հավատում, ուրիշ հարց է։ Սրանով արձանագրվեց միջազգային հանրությանը մոլորության մեջ գցելու Ադրբեջանի գործելակերպը և դա արձանագրեց համաշխարհային բարձրագույն դատական ատյանը»,- ասաց վարչապետը։
Փաշինյանը նշեց, որ երկրորդ կարևոր հանգամանքն այն է, որ դատարանը արձանագրեց Ադբեջանի պատասխանատվությունը Լաչինի միջանցքի փակման համար՝ լուրջ չհամարելով միջանցքը էկոակտիվիստների կողմից փակելու հանգամանքը։
«Դատարանը հենց Ադրբեջանին պարտավորեցրեց բացել միջանցքը։ Դատարանը նաև վերահաստատեց ՀՀ դիրքորոշումը, որ 2020թ-ի նոյեմբերի 9-ի հայտարարությամբ Լաչինի միջանցքը չպետք է լինի Ադրբեջանի վերահսկողության ներքո ու Ադրբեջանը նույն փաստաթղթով պարտավոր է երաշխավորել տրանսպորտային միջոցների ու բեռների երթևեկության անվտանգությունը դեպի Հայաստան ու Հայաստանից դեպի ԼՂ։ Դատարանը հստակ արձանագրեց ԼՂ միավորի գոյությունը, իսկ շփման գծի առկայության վերաբերյալ տվեց միջազգային իրավական նշանակություն։ Արձանագրվեց նաև, որ Լաչինի միջանցքի փակման հետևանքով խաթարվել են սննդի, դեղամիջոցների, առաջին անհրաժեշտության այլ ապրանքների մատակարարումները ԼՂ-ին, սահմանափակվել է էթնիկ հայերի հասանելիությունը մի շարք բժշկական հաստատություններին, հասատվեց ԼՂ-ում հումանիտար ճգնաժամի առկայության փատը։ Դատարանը համարեց, որ Հայաստանը բավարար ապացույցներ չի ներկայացել, որ հենց Ադրբեջանն է ԼՂ-ում բնական գազի ու հոսանքի դադարեցումների մեղավորը։ Նման վիճակի պատճառն այն է, որ ԼՂ-ին գազ մատակարարող խողովակի փականը գտնվում է Հայաստանի համար ոչ հասանելի տեղում։ Այստեղ անհերքելի ապացույցներ Հայաստանը չի կարողացել ներկայացնել։ Բայց սա նաև նշանակում է, որ այն պահին, երբ կկարողանանք ներկայացնել ուղղակի ապացույցներ, այդ հիմքով կկարողանանք նորից դիմել դատարան ու հավանակնությունը, որ դատարանը կբավարարի նաև այս հայցապահանջը, մեծ կլինի»,- ընդգծեց Նիկոլ Փաշինյանը։
