ՀՀ քննչական կոմիտեի Շիրակի մարզային քննչական վարչության, ինչպես նաև ՀՀ ՆԳՆ ոստիկանության ծառայողների կողմից համատեղ իրականացված միջոցառումների արդյունքում պարզվել են 2023թ. փետրվարի 25-ին և 27-ին ոստիկանության աշխատակցի ծառայողական գործունեությանը միջամտելու դեպքերի մի շարք հանգամանքներ:
2023 թվականի փետրվարի 25-ին ՀՀ ՆԳՆ ոստիկանության Ամասիայի բաժնից ՀՀ ՔԿ Շիրակի մարզային քննչական վարչություն հաղորդում է ստացվել այն մասին, որ նույն օրը՝ ժամը 19։30-ի սահմաններում, ոստիկանության աշխատակիցը ծառայություն իրականացնելու ընթացքում Ամասիա բնակավայրի կենտրոնական հրապարակում նկատել է «Վազ 2103» մակնիշի ավտոմեքենա, որն անկանոն պտույտներ կատարելով կանգ է առել հրապարակի միջնամասում։
Ստուգմամբ պարզվել է, որ հիշյալ մեքենայի 34-ամյա վարորդը, տրանսպորտային միջոց վարելու իրավունք չի ունեցել և գտնվել է ոչ սթափ վիճակում։ Վերջինս իջնելով ավտոմեքենայից, քաշքշելով վնասել է ոստիկանության աշխատակցի համազգեստը և մեկ անգամ հարվածել նրան:
Դեպքի առթիվ նախաձեռնված քրեական վարույթով ձեռք բերված փաստերի հիման վրա 34-ամյա տղամարդուն մեղադրանք է ներկայացվել՝ ՀՀ քրեական օրենսգրքի 452-րդ հոդվածի 3-րդ մասով և 344-րդ հոդվածի 2-րդ մասով: Վերջինիս նկատմամբ որպես խափանման միջոց ընտրվել է բացակայելու արգելքը և գրավը՝ 1.000.000 դրամի չափով։
Մեկ այլ դեպքում՝ 2023թ. փետրվարի 27-ին ՀՀ ՆԳՆ ոստիկանության Շիրակի մարզային վարչության Արթիկի բաժնից հաղորդում է ստացվել այն մասին, որ ժամը 01:05-ի սահմաններում, Արթիկ քաղաքի Բաղրամյան-Աբովյան փողոցների խաչմերուկից վիճաբանելու, սեռական բնույթի հայհոյանքներ կատարելու և պարեկային ծառայողների օրինական պահանջները չկատարելու կասկածանքով բաժին է տեղափոխվել նույն մարզի 4 բնակիչ՝ ծնված 1999, 1998, 2000 և 1994 թվականներին:
Այդ ընթացքում 1994թ. ծնված տղամարդը սպառնալիքներ է հնչեցրել ոստիկանության ծառայողների հասցեին, դիմադրություն ցուցաբերել, հարվածել և մարմնական վնասվածքներ պատճառել նրանցից երկուսին:
Դեպքի առթիվ նախաձեռնված քրեական վարույթով ձեռք բերված փաստերի հիման վրա 1994թ. ծնված տղամարդուն մեղադրանք է ներկայացվել՝ ՀՀ քրեական օրենսգրքի 452-րդ հոդվածի 1-ին մասով և 452-րդ հոդվածի 3-րդ մասով նախատեսված հանցանքի կատարման համար:
Այս մեղադրյալի նկատմամբ որպես խափանման միջոց է ընտրվել կալանավորումը։
Վերոհիշյալ երկու դեպքերով ոստիկանության աշխատակիցները ճանաչվել են տուժող:
Նախաձեռնված քրեական վարույթներով կատարվել են դեպքի վայրի զննություններ, առգրավվել են հագուստները, նշանակվել են դատաբժշկական փորձաքննություններ:
Հարցաքննվել են դեպքին ականատես մի շարք վկաներ:
ՀՀ ՆԳՆ ոստիկանության համապատասխան ստորաբաժանումներին տրվել են հանձնարարություններ:
Նախաձեռնված քրեական վարույթներով նախաքննությունը շարունակվում է:
Ծանուցում. Հանցանքի համար մեղադրվողը համարվում է անմեղ, քանի դեռ նրա մեղավորությունն ապացուցված չէ ՀՀ քրեական դատավարության օրենսգրքով սահմանված կարգով` դատարանի` օրինական ուժի մեջ մտած դատավճռով:
