«Փաստ» օրաթերթը գրում է

Արդարադատության նախարարությունն առաջարկում է փոփոխություն և լրացում կատարել Քրեական օրենսգրքում, մասնավորաբար՝ առաջարկվում է սահմանել քրեական պատասխանատվություն հարկադիր կատարման ենթակա այլ ակտերի չկատարման կամ դրանց կատարմանը խոչընդոտելու համար։ Նշվում է, որ 2022 թ. հուլիսի 1-ին ուժի մեջ մտած Քրեական օրենսգրքում ամրագրված է դատական ակտը չկատարելու վերաբերյալ հանցակազմ։ Ներկայում քրեական պատասխանատվության ենթարկվում են միայն դատական ակտերի չկատարման կամ կատարմանը խոչընդոտելու համար, եթե կատարումը հնարավոր չէ հարկադիր կատարման միջոցներով։

Սակայն «Դատական ակտերի հարկադիր կատարման մասին» օրենքում լրացումներ կատարելու արդյունքում հարկադիր կատարման ենթակա է ոչ միայն օրինական ուժի մեջ մտած դատական ակտը, այլ, օրինակ՝ Մրցակցության պաշտպանության հանձնաժողովի կողմից տրված հանձնարարություններ պարունակող որոշումը, քանդման մասին վարչական ակտը, Հանրային ծառայությունները կարգավորող հանձնաժողովի որոշումը, գրավը պետության եկամուտ դարձնելու մասին դատախազի որոշումը։ Հարկադիր կատարման ենթակա ակտերի ցանկը տարեցտարի ավելանում է։ Այսպիսով, հարկադիր կատարման ուղարկվող որոշումները լինում են ոչ միայն գույքային (բռնագանձման), այլև ոչ գույքային բնույթի: Օրինակ՝ նշված հանձնաժողովների կողմից տրված հանձնարարությունները, որոնք կատարման ենթակա են անձամբ պարտապանի կամ վերջինիս ներկայացուցչի կողմից և հնարավոր չէ կատարել հարկադիր կատարման միջոցների կիրառմամբ։

Գործնականում հարկադիր կատարումն ապահովող ծառայությունը, ստանալով վերը նշված մարմինների կայացրած որոշումները, ղեկավարվելով օրենքի 62-րդ հոդվածով, կայացնում է որոշակի գործողություններ կատարելու կամ դրանց կատարումից ձեռնպահ մնալու մասին որոշում, որի համաձայն՝ պարտապանը պարտավոր է սահմանված ժամկետում ապահովել նշված մարմինների կայացրած վարչական ակտով սահմանված գործողությունների (հանձնարարությունների) կատարումը։ Պարտապանը սահմանված ժամկետում հրաժարվում է ապահովել դրանց կատարումը, ինչի հետևանքով հարկադիր կատարման ենթակա ակտերը մնում են անկատար։

Նշված դեպքերում գործող իրավակարգավորումներով հարկադիր կատարողը չունի որևէ լծակ ազդելու պարտապանի վարքագծի վրա կամ այլ միջոցներով ապահովելու այդ ակտերի հարկադիր կատարումը (բացառությամբ, եթե պարտապանը խոչընդոտում է հարկադիր կատարողի օրինական գործողություններին, որի դեպքում սահմանված է վարչական պատասխանատվություն)։ Ուստի առաջարկվում է փոփոխություն և լրացում կատարել Քրեական օրենսգրքում և սահմանել քրեական պատասխանատվություն հարկադիր կատարման ենթակա այլ ակտերի չկատարման կամ դրանց կատարմանը խոչընդոտելու համար։

Նշվում է, որ նախագծի ընդունման դեպքում լրացուցիչ օրենսդրական հիմքեր և երաշխիքներ կստեղծվեն հարկադիր կատարման ենթակա ակտերի անվերապահ կատարման համար՝ սահմանելով հավել յալ գործիք՝ ազդելու պարտապանի վրա՝ կատարելու օրենքի 4-րդ հոդվածով նախատեսված հարկադիր կատարման ենթակա այլ ակտերը։
