«Փաստ» օրաթերթը գրում է
Ինչպես հայտնի է, ԲԴԽ դատավոր անդամի թափուր տեղ է առաջացել, և, մեր ունեցած տեղեկություններով, ԲԴԽ նախագահ Կարեն Անդրեասյանն ուզում է իր «ցանկալի» մարդուն տանել ԲԴԽ: Դատական համակարգում խոսում են, որ Կարեն Անդրեասյանը, ըստ էության, գնում է իր նախորդի՝ Գագիկ Ջհանգիրյանի հետքերով և նպատակ ունի ԲԴԽ-ն վերջնականապես ու ամբողջությամբ վերածել պատժիչ գործիքի, որտեղ որոշումները կընդունվեն միաձայն, և այդ ճանապարհին դատավորների շահերը հետապնդող որևէ անդամ ԲԴԽ-ում փաստացի այլևս չի մնացել:
Համակարգում նաև նկատում են, որ այս գործում ԲԴԽ նախագահը գործում է իր ընկերոջ՝ արդարադատության նախարարի հետ համագործակցված: Այսինքն, մի ընկերը չենթարկվող դատավորների նկատմամբ վարույթ է նախաձեռնում, մյուսը ԲԴԽում առանց խոչընդոտների ընթացք է տալիս այդ «պրոցեսներին»: Ի դեպ, ինչ վերաբերում է Ռուբիկ Մխիթարյանին, ապա թե՛ իրավապահ համակարգում, թե՛ դատական համակարգում, թե՛ հատկապես փաստաբանների շրջանում նա համարվում է բավական «խոցելի» և համադրվում է տխրահռչակ Մացոյի՝ Մնացական Մարտիրոսյանի և Արմեն Դանիել յանի հետ։ Ի դեպ, մի քանի իրավաբաններ մեզ հետ զրույցում նշում էին, որ Ռուբիկ Մխիթարյանին պետք էր ոչ թե ԲԴԽ տանել, այլ նույնիսկ կարգապահական վարույթ նախաձեռնել նրա նկատմամբ:
Մասնավորաբար, եթե նույնիսկ այլ հարցերը մի կողմ դրվեն, ըստ մեր զրուցակիցների, հենց միայն բժիշկ, պատգամավոր Արմեն Չարչյանին կալանավորելու որոշումը, որը Սահմանադրական դատարանում խայտառակ ձևով փլուզվեց, պետք է հանդիսանար Ռուբիկ Մխիթարյանի նկատմամբ կարգապահական վարույթ հարուցելու հիմք, ինչը ժամանակին չէր բացառում նույնիսկ Գագիկ Ջհանգիրյանը, քանի որ այդ աստիճան ակնհայտ էր դատական սխալը:
