«Փաստ» օրաթերթը գրում է

Պետական եկամուտների կոմիտեի՝ հանրային քննարկման ներկայացված նախագծի ընդունման արդյունքում անհատ ձեռնարկատեր կամ նոտար չհանդիսացող ֆիզիկական անձանց մոտ հարկային մարմինը հնարավորություն կունենա իրականացնելու համալիր հարկային ստուգում։ Առաջարկվում է փոփոխություններ և լրացում կատարել Հարկային օրենսգրքում: Օրենսգրքի 335-րդ հոդվածի ներկայիս կարգավորումներով հարկային մարմնի կողմից իր լիազորությունների շրջանակներում անհատ ձեռնարկատեր կամ նոտար չհանդիսացող ֆիզիկական անձանց մոտ հարկային ստուգում իրականացնելու հնարավորություն սահմանված չէ։

2022 թ.-ի դեկտեմբերի 23-ին Ազգային ժողովի կողմից ընդունվել է «Հայաստանի Հանրապետության հարկային օրենսգրքում փոփոխություններ և լրացումներ կատարելու մասին» ՀՕ-593-Ն օրենքը, որով, ի թիվս այլ փոփոխությունների, օրենսգրքի 156-րդ հոդվածի լրացմամբ ֆիզիկական անձանց համար սահմանվել է եկամտային հարկի տարեկան հաշվարկները (հայտարարագրերը) ներկայացնելու պարտականություն։ Մասնավորաբար՝ նախատեսվել է, որ եկամտային հարկի տարեկան հաշվարկներ չներկայացնող՝ ՀՀ ռեզիդենտ հանդիսացող ՀՀ քաղաքացիները (բացառությամբ հաշվետու տարվա դեկտեմբերի 31-ի դրությամբ անչափահաս համարվող ֆիզիկական անձանց) մինչև յուրաքանչյուր հաշվետու ժամանակաշրջանին հաջորդող հարկային տարվա մայիսի 1-ը ներառյալ օրենսգրքի 53րդ հոդվածով սահմանված կարգով հարկային մարմին են ներկայացնում եկամտային հարկի տարեկան հաշվարկներ։

Միաժամանակ, ՀՀ ՊԵԿ նախագահի և Արժույթի միջազգային հիմնադրամի հետ կայացված հանդիպման արդյունքներով ևս որոշվել է օրենսդրորեն նախատեսել ֆիզիկական անձանց համար համալիր հարկային ստուգման իրականացման հնարավորություն: Հաշվի առնելով այն հանգամանքը, որ հարկային մարմինը ներկայումս գործող օրենսդրական կանոնակարգումների համաձայն չունի հսկողական գործիքակազմ անհատ ձեռնարկատեր կամ նոտար չհանդիսացող ֆիզիկական անձանց նկատմամբ, նախագծով սահմանվել է, որ համալիր հարկային ստուգում կարող է իրականացնել նաև անհատ ձեռնարկատեր կամ նոտար չհանդիսացող ֆիզիկական անձանց մոտ։

Միաժամանակ, նախատեսվել են այն դեպքերը, երբ վերջիններիս մոտ կարող է իրականացվել համալիր հարկային ստուգում, մասնավորապես՝ հարկային մարմնի վերլուծության արդյունքների հիման վրա, պետության օրինական շահերին վնաս հասցնելու կամ դրա վտանգի, այդ թվում՝ հարկի գումար, հարկման բազա թաքցնելու կամ դրանք պակաս ցույց տալու կամ հարկային մարմնին հսկողության լիազորություններ վերապահող իրավական ակտերի պահանջները խախտելու մասին հարկային մարմնի ստացած տեղեկությունների հիման վրա, անհատ ձեռնարկատեր կամ նոտար չհանդիսացող ֆիզիկական անձը դիմում է ներկայացրել համալիր հարկային ստուգում իրականացնելու վերաբերյալ։
