«Փաստ» օրաթերթը գրում է

Պաշտպանության նախարարությունն առաջարկում է փոփոխություն կատարել կառավարության 2008 թ. մայիսի 22-ի N 595-ն որոշման մեջ: Գերատեսչությունը նշում է` նախագծի ընդունումը պայմանավորված է 2022 թ. հուլիսի 1-ից ուժի մեջ մտած նոր Քրեական և Քրեակատարողական օրենսգրքերի դրույթներին համապատասխանեցման անհրաժեշտությամբ, ինչպես նաև հիմք ընդունելով «Մի շարք օրենքների կիրարկումն ապահովող միջոցառումների ցանկերը հաստատելու մասին» վարչապետի 2022 թ. սեպտեմբերի 28-ի 1114-Ա որոշման հավելված N 3-ով հաստատված ցանկի 1-ին կետը: Կառավարության N 595-Ն որոշմամբ սահմանվում են Քրեական դատավարության օրենսգրքով նախատեսված դեպքերում ձերբակալված, ինչպես նաև կալանքի դատապարտված զինծառայողներին կայազորային կարգապահական մեկուսարաններ ընդունելու կարգը և այլ հարաբերություններ:

Քրեական նոր օրենսգրքի 56րդ հոդվածով նախատեսվում է պատժի տեսակները, որում «կալանքը» որպես պատժատեսակ նախատեսված չէ և փոխարենը նախատեսվում է «կարճաժամկետ ազատազրկումը», իսկ Քրեակատարողական նոր օրենսգրքի 13-րդ հոդվածի 4-րդ մասի համաձայն, դատապարտված զինծառայողների նկատմամբ կարճաժամկետ ազատազրկման կատարումն ապահովում է ՀՀ պաշտպանության նախարարության համակարգում գործող կայազորային կարգապահական մեկուսարանը: Ուստի Քրեակատարողական նոր օրենսգրքի դրույթներին համապատասխանեցնելու նպատակով անհրաժեշտ է կառավարության N 595-Ն որոշման մեջ կատարել համապատասխան փոփոխություն: Այսպիսով` որոշման նախագծի համաձայն, ՀՀ ՊՆ ռազմական ոստիկանության կայազորային կարգապահական մեկուսարանում պահվելու են նաև կարճաժամկետ ազատազրկման դատապարտված զինծառայողները:
