«Փաստ» օրաթերթը գրում է
Էկոնոմիկայի նախարարությունն առաջարկում է փոփոխություն կատարել Քաղաքացիական օրենսգրքում: 1137-րդ հոդվածով նախատեսված գործող կարգավորման համաձայն՝ հեղինակային իրավունքով պահպանվող օբյեկտի առանց համապատասխան թույլտվության օգտագործելու դեպքում իրավատիրոջը հնարավորություն է տրվում առանց թույլտվության հեղինակային իրավունքի օբյեկտն օգտագործած անձից պահանջել հոնորարի կամ վարձատրության կրկնակի չափով փոխհատուցում, որը իրավատերը կստանար, եթե իրավախախտողը թույլտվություն ունենար հեղինակային իրավունքի օբյեկտի օգտագործման համար, կամ խախտման հետևանքով պատճառած փաստացի վնասին համարժեք հատուցում, ներառյալ՝ բաց թողնված օգուտը։
Նշվում է, որ հաճախ գործնականում անհնար է ֆիքսել հոնորարի կամ վարձատրության մի չափ, որից հնարավոր կլինի հաշվարկել դրա կրկնակին, բացի դա, իրավատերերը հաճախ զրկված են իրավախախտման հստակ ծավալները արձանագրող ապացույցների հավաքման իրական հնարավորությունից, ինչի հետևանքով գրեթե անհնար է հիմնավորել վնասի չափը։ Դատական պրակտիկայի ուսումնասիրությունը ևս ցույց է տալիս, որ հեղինակային իրավունքի խախտման հիմքով գործող հատուցումները գրեթե չեն կիրառվում, անհատ հեղինակների զգալի մասը հրաժարվում է իր իրավունքների պաշտպանությունից վճարունակ չլինելու պատճառով, փաստաբանական ծառայություններից չօգտվելու արդյունքում։
Ներկայացված նախագծով առաջարկվում է նախատեսել իրավատիրոջ կողմից օրենքով նախատեսված սահմանված չափով փոխհատուցում ստանալու հնարավորություն, որի դեպքում իրավատերը դատարանում որպես հայցվոր հանդես գալիս պարտավոր չի լինի ապացուցել, որ կրել է որևէ չափի ֆինանսական վնաս, որպեսզի պատասխանողի վրա, հայցի բավարարման արդյունքում, դրվի իրավատիրոջը որպես փոխհատուցում որոշակի գումար վճարելու պարտականություն, փոխարենը իրավատերը պետք է ապացուցի միայն հեղինակային իրավունքի օբյեկտի ապօրինի օգտագործման փաստը։ Այսպիսով՝ առաջարկվում է սահմանել 20 000-ից մինչև 2 000 000 դրամի չափով փոխհատուցման հնարավորություն։ 2021թ.-ի մայիսի 5-ին ընդունված Քրեական օրենսգրքի 227-րդ հոդվածի համաձայն՝ հեղինակային իրավունքի խախտումների դեպքում նախատեսվող տուգանքի չափը սահմանվել է անձի եկամտի, իսկ դրա բացակայության դեպքում արարքի կատարման պահին սահմանված նվազագույն աշխատավարձի 20-ապատիկի չափով, իսկ իրավաբանական անձանց դեպքում դրա եկամտի 20 տոկոսի չափով՝ մոտ 1,500,000 դրամ:
Նախագծով առաջարկվում է փոխհատուցման ստորին շեմ սահմանել նաև սահմանված նվազագույն աշխատավարձի 200-ապատիկը այն դեպքերի համար, երբ արտադատական կարգով իրավախախտը հրաժարվում է վերացնել խախտումը։ Սակայն առկա են դեպքեր, երբ հեղինակային իրավունք խախտողը տեղյակ չէ, որ իր գործողությամբ խախտում է այլ անձի հեղինակային իրավունքներ, այս դեպքում նվազագույն աշխատավարձի 200-ապատիկը որպես ստորին շեմ փոխհատուցման տարբերակից օգտվելիս, մինչև դատարան դիմելը, հեղինակը պարտավոր է գրավոր եղանակով ծանուցել իրավախախտողին իրավախախտման վերաբերյալ, պահանջել իրավախախտողից դադարեցնել իրավախախտումը և տեղեկացնել իրավախախտումն անհապաղ չդադարեցնելու դեպքում նվազագույն աշխատավարձի 200-ապատիկից մինչև 2000-ապատիկին հասնող փոխհատուցման մասին։
