ՀՀ քննչական կոմիտեի Սյունիքի մարզային քննչական վարչությունում քննվող քրեական վարույթի շրջանակներում իրականացված քննչական և դատավարական գործողությունների արդյունքում պարզվել են 2023թ. մարտի  10-ին Կապան համայնքի Նորաշենիկ բնակավայրում տեղի ունեցած մահվան ելքով ճանապարհատրանսպորտային պատահարի մի շարք հանգամանքներ:

2023թ. մարտի 10-ին՝ ժամը 14:10-ին Կապան քաղաքի 75-ամյա բնակչի կողմից վարած «Պազ 3206-110» մակնիշի ավտոբուսը, ուղևորներով դուրս է եկել երթևեկելի գոտուց և գլորվել գետը։

Դրա հետևանքով 23 ուղևորները և վարորդը, տարբեր մարմնական վնասվածքներով,  տեղափոխվել են բժշկական կենտրոն, որտեղ ուղևորներից մեկը, ստացած մարմնական վնասվածքներից, մահացել է:

Դեպքի առթիվ նախաձեռնվել է քրեական վարույթ՝ ՀՀ քրեական օրենսգրքի 342-րդ հոդվածի 2-րդ  մասի հատկանիշներով։

Նշանակվել են դիակի դատաբժշկական և  դատաբժշկական փորձաքննություններ: Հիվանդանոց տեղափոխված 23 ուղևորները ճանաչվել են տուժող։ Քրեական վարույթի շրջանակներում նշանակվել է նաև դատաավտոտեխնիկական և դատահետքաբանական համալիր փորձաքննություն։

Նախաքննության ընթացքում կատարված վարութային և ապացուցողական գործողությունների, այդ թվում նաև նշանակված համալիր փորձաքննության արդյունքում հիմնավորվել է, որ 2023թ. մարտի  10-ին՝ ժամը 14:20-ին, 75-ամյա տղամարդը, վարելով իրեն ամրակցված «Պազ 3206-110» մակնիշի ավտոբուսը, ուղևորվելով Կապան համայնքի Ուխտավայր բնակավայրից, Ուխտավայրի դպրոցի աշակերտներին և ուսուցչական կոլեկտիվի անդամներին դեպի Կապան քաղաք տեղափոխելիս, ուշադիր չհետևելով առջևում տիրող ճանապարհատրանսպորտային իրադրության զարգացմանը, չընտրելով երթևեկության համապատասխան անվտանգ ու սահուն ռեժիմ, իրականացրել է իր վարած տրանսպորտային միջոցի ընթացքի ոչ պատշաճ  և վտանգավոր կառավարում՝ ստեղծելով վթարային իրադրություն: Արդյունքում, ավտոբուսը դուրս է եկել ճանապարհի սահմաններից և Առաջաձոր բնակավայրի կամրջի մոտ գլխիվայր ընկել Աճանան գետը, ինչի  հետևանքով ուղևորներից մեկը՝ ուսուցչուհի, ստացած մարմնական վնասվածքներից մահացել է, իսկ մնացած 22 ուղևորներն ստացել են տարբեր աստիճանների մարմնական վնասվածքներ:

Քննությամբ պարզվել է նաև, որ  ավտոբուսի կառավարելիությունը և ընթացքի կայունությունն ապահովող համակարգերը, ագրեգատները և դետալները, ղեկային կառավարման ու բանվորական արգելակային համակարգերը, ընթացային մասերը, մինչև տվյալ պատահարը, նախընթաց շահագործման ընթացքում գտնվել են սարքին վիճակում:

Ձեռք բերված փաստերի հիման վրա վարույթն իրականացնող մարմնի կողմից միջնորդություն է ներկայացվել հսկող դատախազին՝ ավտոբուսի վարորդի  նկատմամբ ՀՀ քրեական օրենսգրքի 342-րդ հոդվածի 2-րդ մասով հանրային քրեական հետապնդում հարուցելու վերաբերյալ։
