«Փաստ» օրաթերթը գրում է

Էկոնոմիկայի նախարարությունն առաջարկում է լրացում կատարել «Սննդամթերքի անվտանգության մասին» և փոփոխություն ու լրացում՝ «Վարչական իրավախախտումների վերաբերյալ» օրենքներում: Նշվում է, որ «Սննդամթերքի անվտանգության մասին» օրենքում լրացում կատարելու անհրաժեշտությունը պայմանավորված է նրանով, որ ՀՀ-ում կանոնակարգված չէ կենսաբանական ակտիվ հավելումների մանրածախ վաճառքը: Ներկայումս այն մեծամասամբ վաճառվում է ֆիզիկական անձանց սոցիալական ցանցերի միջոցով և ԵԱՏՄ միասնական ռեեստրում ու սննդի շղթայի օպերատորների բազայում գրանցում չունեցող ներմուծող ընկերությունների կողմից:

Բազմաթիվ են դեպքերը, երբ վաճառվող կենսաբանական ակտիվ հավելումները չունեն պետական գրանցում, չեն համապատասխանում ԵԱՏՄ տեխնիկական կանոնակարգերի պարտադիր կիրառման պահանջներին կամ ունեն պետական գրանցում այլ չափաքանակով, իսկ տուփի վրա նշվում է մեկ ուրիշ չափաքանակ: Առողջապահության նախարարության կողմից նույնպես արձանագրվել են շատ դեպքեր, երբ կենսաբանական ակտիվ հավելման մեջ առկա է դեղերի ակտիվ բաղադրատարր հանդիսացող նյութ կամ նյութի համարժեք, այն դրսևորում է դեղաբանական ակտիվություն, կիրառվում է բուժական նպատակներով և կենսաբանական ակտիվ հավելում չի հանդիսանում, ինչը երկարատև օգտագործման ընթացքում կարող է վնաս պատճառել մարդու առողջությանը:

Ուստի անհրաժեշտ է ուժեղացնել վերահսկողությունը և սահմանել իրավական հիմք, որ ՀՀ տարածքում կենսաբանական ակտիվ հավելումներ վաճառելու իրավունք ունենան միայն դեղատները, քանի որ վերջիններս ունեն հատուկ սարքավորումներ և որակավորում ունեցող աձնակազմ, ինչի շնորհիվ կարող են ապահովել պահպանման պայմանները, ջերմային ռեժիմը և սպառողին տրամադրել անհրաժեշտ մասնագիտական տեղեկատվություն: Անհրաժեշտ է փոփոխություն և լրացում կատարել նաև «Վարչական իրավախախտումների վերաբերյալ» օրենսգրքում: Մասնավորաբար, 158-րդ հոդվածում կատարել լրացում առ այն, որ դեղատներից բացի այլ վայրերում կենսաբանական ակտիվ հավելումների վաճառքի դեպքում իրավախախտում կատարած անձանց նկատմամբ կնշանակվի վարչական պատասխանատվություն՝ կսահմանվեն արարքին համարժեք վարչական տույժեր: Նախագծի նպատակն է կանոնակարգել կենսաբանական ակտիվ հավելումների վաճառքը:
