«Փաստ» օրաթերթը գրում է

Լրատվամիջոցները, փաստաբանները, իրավաբանական համքարության առանձին համարձակ ներկայացուցիչները պարբերաբար նշում են, որ արդարադատության նախարար - ԲԴԽ նախագահ զույգը շարունակում է արդարադատության համակարգն ավիրելու գործը՝ վերջնանպատակ ունենալով դատարանները դարձնել մեկ անձի լիարժեք և անվերապահ կամակատար: Հասկանալի է, թե ով է այդ «մեկ անձը»: Դե ինչ, Կարեն Անդրեասյանի և Գրիգոր Մինասյանի եռանդուն ջանքերը աննկատ չեն մնացել ու «ըստ արժանվույն» են գնահատվել ոչ միայն Հայաստանում, այլև «դրսում». ի մասնավորի, Դատավորների եվրոպական միության (European Association of Judges)՝ հունիսի 2-ին Աթենքում տեղի ունեցած տարեկան համաժողովում Հայաստանի վերաբերյալ բավականին կոշտ բանաձև է ընդունվել:

Նախ՝ Դատավորների եվրոպական միությունը մտահոգություն է հայտնել «արդարադատության նախարարի կողմից դատավորների նկատմամբ կարգապահական վարույթներ հարուցելու լիազորության կապակցությամբ, որպիսիք հանգուցալուծվում են Բարձրագույն դատական խորհրդում: Պետության գործադիր իշխանության մաս կազմող արդարադատության նախարարին նման լիազորության ընձեռումը վտանգում է դատավորների անկախությունը»: Դիվանագիտորեն «մտահոգություն» են նշել, մինչդեռ սա բավականին ծանր դիտողություն է, կարելի է ասել: Ավելին՝ «Դատավորների եվրոպական միությունը լիովին անընդունելի է համարում վերջերս իրականացվող քայլերը, որոնք ուղղված են դատավորների՝ արդարադատության համակարգի գործունեության վերաբերյալ հրապարակային արտահայտվելու, ցանկացած տեսակետ կամ մտահոգություն արտահայտելուց զերծ պահելուն»:

Տեսեք՝ լիովին անընդունելի: Չգիտենք՝ ԲԴԽ նախագահը, նրա գործընկեր արդարադատության նախարարը կհասկանա՞ն, որ իրենց, մեծ հաշվով, կարմիրի վերափոխվող դեղին քարտ են ցույց տալիս Եվրոպայից: Էլ ավելին. «Դատավորների եվրոպական միությունը (EAJ) դատապարտում է կարգապահական վարույթների նման բացահայտ չարաշահումները, որոնք միտված են զսպելու դատական համակարգի գործունեությանը վերաբերող հարցերում քննադատական խոսք հնչեցնելու դատական իշխանության ներկայացուցիչների արտահայտվելու, խոսքի ազատության իրավունքի իրացումը»: Բազմաթիվ մտահոգիչ փաստեր ու երևույթներ արձանագրելուց հետո, հասկանալի է, նման դատապարտող ամփոփումն անխուսափելի էր:

Ի՞նչն է հատկանշական. դատական համակարգը գործադիրի ոտաշոր դարձնելու հիմնավոր մեղադրանքներն ուղղված են ներկայացուցիչներին այն իշխանության, որոնք օրնիբուն միայն դատական համակարգի անկախության մասին ինչ-որ բաներ էին հայտարարում ու դեռ հայտարարում են, սակայն իրականում զբաղված են տրամագծորեն հակառակով: Կընկալե՞ն, որ իրենց խաղը «վառված» է, ու առժամանակ կզսպե՞ն դատական համակարգի դեմ ուղղված իրենց գործողությունները, թե՞ նման զգուշացումները բանի տեղ չեն դնի, ցույց կտա ժամանակը:
