Ո՞ր դեպքերում պարեկն իրավունք ունի ֆիզիկական nւժ գործադրել

Ոստիկանության պետի 2020 թվականի սեպտեմբերի 23-ի 36-Լ հրամանով հաստատվել է ոստիկանության պարեկային ծառայության կանոնագիրքը։
Iravaban.net-ը հայտնում է, որ կանոնագրքի 5.5 մասով սահմանված է, թե որ դեպքում կարող է պարեկը ֆիզիկական ուժ գործադրել։
Սահմանաված է, որ իրավախախտումները կանխելու կամ խափանելու, իրավախախտներին բռնելու և ոստիկանություն ներկայացնելու, ոստիկանության ծառայողի օրինական պահանջներին չենթարկվելու կամ դիմադրություն ցույց տալու դեպքերում, ինչպես նաև ինքնապաշտպանության նպատակով ոստիկանության ծառայողն իրավունք ունի իրավախախտների նկատմամբ գործադրել ֆիզիկական ուժ (այդ թվում՝ ձեռնամարտի հնարքներ), ինչպես նաև ձեռքի տակ գտնվող անհրաժեշտ առարկաներ, եթե ոչ ուժային միջոցները չեն ապահովում ոստիկանության վրա դրված պարտականությունների կատարումը:
Պարեկային ծառայողներն իրավունք ունեն գործադրել ֆիզիկական ուժ, այդ թվում մարտական հատուկ հնարքներ՝ սեփական և այլ անձանց անվտանգությունն ապահովելու, իրավախախտումների կանխման, ինչպես նաև իրավախախտում կատարած անձանց բռնելու նպատակով, եթե այլ եղանակով հնարավոր չէ արդյունավետ կերպով իրականացնել պարեկային ծառայողի գործառույթները։
Ֆիզիկական ուժի գործադրումն ակնհայտ հղի և սահմանափակ կարողություններով անձանց, անչափահասների ու ծերերի նկատմամբ արգելվում է, բացառությամբ այն դեպքերի, երբ վերջիններս իրականացնում են զինված կամ խմբակային հարձակում, ոստիկանին ցույց են տալիս զինված դիմադրություն, որի հետևանքով վտանգվում է ոստիկանության ծառայողի կամ այլ անձանց կյանքը կամ առողջությունը։
Գործադրված ֆիզիկական ուժի արդյունքում անձանց ստացած վնասվածքների կամ մահվան դեպքում պարեկային ծառայողն անմիջապես զեկուցում է այդ մասին անմիջական հրամանատարին։
